    투자협정 정책의 딜레마: 최근 인도사례의 고찰 = Policy dilemma of Bilateral Investment Treaties: A Case Study of Recent Indian Government Policies

    Developing countries have competitively signed bilateral investment treaties (BITs) in order to attract more foreign direct investment. Though the benefits of participation in BITs for developing countries are now perceived less apparent than expected, BITs are still useful tools to afford legal security needed by foreign investors. On the other hand, developing countries become increasingly aware of the potential costs of BITs with the rapid growth in the number of investor-state dispute settlement cases. Governments in many developing countries are now facing a challenge in their BIT policies to find a proper balance between the two objectives of promoting inward foreign investment and mitigating potential risk being claimed by foreign investors.
    This paper studies the case of the Indian government which is facing a policy dilemma of BITs. As a reaction to a number of arbitration claims brought by foreign investors, the Indian government drafted a new model BIT text which will serve as a template for India’s future BIT renegotiations. The new model reflects a significantly regressive attitudes towards foreign investment protection. It may help Indian government avoid arbitration claims, but curtails the usefulness to foreign investors. In contrast, the Indian government is eager to pursue a bilateral investment treaty with the United States. The Indian government led by PM Modi puts emphasis on foreign direct investment to revive the economy and undertakes a number of initiatives, including the restart of stalled negotiations on BIT with the US, to restore foreign investor confidence. The India government’s dilemma is that there is a vast divergence between its new model BIT and the US model BIT on fundamental issues. The US is not expected to cede considerable ground to conclude a low-standard BIT with India. If India agrees to US demands for a high-standard BIT, then its new model BIT will lose ground as an acceptable proposal in the future negotiations with other capital exporting countrie

    개도국들은 외국인직접투자의 유치를 목적으로 경쟁적으로 양자간투자협정을 체결해왔다. 외국인투자유치 측면에서 기대한 만큼의 긍정적 효과는 드러나지 않고 있지만, 여전히 투자협정은 외국인투자자들이 필요로 하는 투자보호에 관한 법적 안전성을 제공하는 유용한 수단이 되고 있다. 그러나 현지국 정부가 외국인투자자에 의해 국제중재에 피소되는 투자자 대 정부 간 분쟁이 급속히 증가하면서, 투자협정의 잠재적 비용에 대한 개도국 정부의 인식이 제고되고 있다. 이에 따라 외국인투자유치의 증대와 투자분쟁의 잠재적 위험의 축소라는 목표 사이에서 투자협정의 방향에 관한 개도국 정부의 정책적 고민이 드러나고 있다. 본 논문에서는 이러한 고민이 정책적 딜레마의 모습으로 나타나고 있는 최근 인도 정부의 사례에 대해 고찰하고 있다. 외국인투자자에 의해 피소되는 다수의 사례들이 대두되면서 이에 대한 대응으로 인도정부는 기존에 체결한 양자간투자협정들에 대한 개정 협상을 추진하기로 하고 협상 시 인도정부의 입장이 될 인도의 개정 투자협정모델을 발표하였다. 이 모델은 외국인투자자에 대한 보호 수준을 크게 후퇴시킨 내용으로서, 투자유치 수단으로서의 투자협정의 유용성을 훼손하더라도 인도정부의 피소 위험을 축소하는데 초점을 맞추고 있다. 이와 대조적으로, 최근 인도의 모디 정부는 인도경제의 재도약을 목표로 외국인직접투자 유치정책에 방점을 두고, 이의 일환으로 미국과의 양자간투자협정을 적극 추진하고 있다. 문제는 인도의 개정 투자협정 모델과 미국의 투자협정 모델 간에 주요 내용에서 큰 괴리가 존재한다는 점에 있다. 미국이 인도의 개정 투자협정모델의 내용을 상당히 수용하는 선에서 낮은 수준의 투자협정을 받아들일 가능성은 희박하다. 반면 인도정부가 미국의 요구를 수용하여 높은 수준의 투자협정을 체결하는 경우, 향후 다른 선진국들과의 투자협정 개정협상 과정에서도 인도정부는 자국의 개정 투자협정 모델을 주장하기에 어려운 입장에 놓일 수밖에 없다. 외국인투자유치를 목표로 한 미국과의 양자간투자협정 체결, 투자분쟁의 회피를 목표로 한 개정 투자협정모델은 인도정부가 동시에 추구하기 어려운 과제이다.

    개도국들은 외국인직접투자의 유치를 목적으로 경쟁적으로 양자간투자협정을 체결해왔다. 외국인투자유치 측면에서 기대한 만큼의 긍정적 효과는 드러나지 않고 있지만, 여전히 투자협정은 외국인투자자들이 필요로 하는 투자보호에 관한 법적 안전성을 제공하는 유용한 수단이 되고 있다. 그러나 현지국 정부가 외국인투자자에 의해 국제중재에 피소되는 투자자 대 정부 간 분쟁이 급속히 증가하면서, 투자협정의 잠재적 비용에 대한 개도국 정부의 인식이 제고되고 있다. 이에 따라 외국인투자유치의 증대와 투자분쟁의 잠재적 위험의 축소라는 목표 사이에서 투자협정의 방향에 관한 개도국 정부의 정책적 고민이 드러나고 있다. 본 논문에서는 이러한 고민이 정책적 딜레마의 모습으로 나타나고 있는 최근 인도 정부의 사례에 대해 고찰하고 있다. 외국인투자자에 의해 피소되는 다수의 사례들이 대두되면서 이에 대한 대응으로 인도정부는 기존에 체결한 양자간투자협정들에 대한 개정 협상을 추진하기로 하고 협상 시 인도정부의 입장이 될 인도의 개정 투자협정모델을 발표하였다. 이 모델은 외국인투자자에 대한 보호 수준을 크게 후퇴시킨 내용으로서, 투자유치 수단으로서의 투자협정의 유용성을 훼손하더라도 인도정부의 피소 위험을 축소하는데 초점을 맞추고 있다. 이와 대조적으로, 최근 인도의 모디 정부는 인도경제의 재도약을 목표로 외국인직접투자 유치정책에 방점을 두고, 이의 일환으로 미국과의 양자간투자협정을 적극 추진하고 있다. 문제는 인도의 개정 투자협정 모델과 미국의 투자협정 모델 간에 주요 내용에서 큰 괴리가 존재한다는 점에 있다. 미국이 인도의 개정 투자협정모델의 내용을 상당히 수용하는 선에서 낮은 수준의 투자협정을 받아들일 가능성은 희박하다. 반면 인도정부가 미국의 요구를 수용하여 높은 수준의 투자협정을 체결하는 경우, 향후 다른 선진국들과의 투자협정 개정협상 과정에서도 인도정부는 자국의 개정 투자협정 모델을 주장하기에 어려운 입장에 놓일 수밖에 없다. 외국인투자유치를 목표로 한 미국과의 양자간투자협정 체결, 투자분쟁의 회피를 목표로 한 개정 투자협정모델은 인도정부가 동시에 추구하기 어려운 과제이다.
