청소년 대상 성범죄자 신상공개제도의 효과성 분석 = The Effects of Notification Policy of Sexual Offenders against Adolescents on Enhancing Public Awareness of Sexual Crimes

국문 초록 (Abstract)

지난 2001년부터 시행되고 있는 청소년 대상 성범죄자에 대한 신상공개 제도는 위헌논란을 중심으로 많은 사회적 관심과 함께 첨예한 찬반논란을 불러온 정책이다. 이 제도는 청소년 대상 성범죄자에 대한 신상공개라는 강력한 사회적 처벌을 매개로 청소년 대상 성범죄에 대한 경각심을 높이고 이를 통해 잠재적 범죄자의 범죄행위를 억제하는 일반예방효과에 초점을 둔 정책이다. 따라서 미국의 Megan법과는 달리 청소년 대상 성범죄자에 대한 사법당국의 관리를 용이하게 하거나 또는 성범죄자의 지역사회 거주사실을 공지함으로써 지역주민의 안전을 확보하는 지역사회보호의 효과는 상대적으로 크지 않다. 이와 같은 정책목적에 대한 현행 제도의 효과성 탐색을 위해 본 연구는 고교생 이상 성인 1,409명을 대상으로 이 제도의 시행이 일반 시민들의 청소년 대상 성범죄에 대한 경각심을 제고하는데 얼마나 영향을 주었으며 또 이와 관련이 있는 요인들을 분석하였다. 연구결과는 현행 제도가 청소년 대상의 성범죄에 대한 일반인의 경각심을 높이는 효과를 일정 수준에서 지지하였으며, 신상공개제도에 대한 관심 및 지지, 공개대상자의 지역사회 거주 사실 확인 등이 응답자의 경각심 제고에 중요한 영향력을 주는 것으로 나타났다. 연구결과를 토대로 향후 신상공개제도의 일반예방효과를 높이고 이를 통해 이 제도의 궁극적 정책목적인 성범죄의 위험으로부터 청소년을 보호하기 위한 정책대안을 제시하였다.

This study examined the effect of notification policy of sexual offenders against adolescents on enhancing the general public`s awareness of sexual crimes. The study is based on the assumption that heightening public awareness can be a starting point in combating such crimes. Results of the data, drawn from a sample of 1,409 respondents across the nation, showed that the notification policy enhanced public awareness. Factors related to this increase in awareness were respondents` concern about or familiarity with the policy, and their experience in identifying the existence of known sexual offenders in their communities. Based on the results of this study, strategies for enhancing public awareness of sexual crimes on adolescents were formulated. The need to develop treatment programs for sexual offenders and to conduct future research for evaluating current policy`s effectiveness were also discussed.
