This article comprehensively examines the coherence and limitations of the international and domestic legal frameworks applicable to civil nuclear-powered ships in light of maritime decarbonization and advances in small modular reactor (SMR) technology, and proposes directions for legal reform. At the international level, it argues that while UNCLOS provides the basic framework for passage through territorial seas and access to ports, significant discretion remains with coastal States, and that whereas IMO rules have developed around ship safety, the IAEA framework, designed primarily for land-based fixed nuclear installations, does not adequately encompass shipboard reactors. As a result, ship-mounted reactors remain subject to regulatory gaps in safety, safeguards, liability, and compensation. At the domestic level, the article examines the ambiguity in the scope of application and licensing system under the Nuclear Safety Act for reactors installed on ships, as well as the lack of decommissioning-related provisions, and identifies the inadequacy of the concepts of nuclear operator and liability insurance under the Nuclear Damage Compensation Act. It further suggests a multilayered compensation scheme and a dual approval structure dividing maritime, nuclear, and overlapping technical areas between maritime authorities, classification societies, and the nuclear regulator.
