저작권대리중개업의 현안과 개선 방안

국문 초록 (Abstract)

이 글은 저작권대리중개업을 둘러싼 최근의 논쟁을 해결하기 위하여 저작권대리중개제도의 나아갈 방향과 개선 방안을 제시하고자 하였다. 이를 위하여 저작권대리중개업의 현황과 관련 법령 및 판례를 분석하는 한편, 저작권신탁관리단체 등의 실태조사를 기반으로 대리중개업의 실무적 쟁점을 검토하였다. 우선, 현행 저작권법은 저작물 등의 이용과 관련한 포괄적 대리를 신탁관리업의 범주에 포함시키고 있다. 그런데 단순히 대리중개 신고를 한 일부 대리중개업에서 권리자와 포괄적 권리위임계약을 체결하고 신탁관리업의 범주에 속하는 신탁 업무를 수행하고 있어 시장에 혼란을 초래하여 왔다. 이에 ‘포괄적으로 대리하는 경우’의 구체적인 의미와 범위를 검토하였다. 그리고 최근 저작권신탁관리단체에게 대리중개업을 중지하는 문화체육관광부의 명령으로 인하여 회원들의 불편과 비효율성 등 여러 가지 문제점이 초래됨에 따라 신탁관리단체에 의한 대리중개업의 병행의 문제점과 합리적인 해결 방안들을 구체적으로 검토하였다. 저작권신탁관리단체가 대리중개 업무를 병행하게 되면 다음과 같은 다양한 이점이 있다. 첫째, 신탁관리단체는 저작권자를 회원으로 두고 있으므로 이용자가 이용허락 등을 위해 권리자를 찾는 어려움을 해결할 수 있다. 둘째, 신탁관리단체에 의한 대리중개 병행은 이용허락의 편의성 외에도 이로 인해 궁극적으로 저작권침해를 감소시킬 수 있다. 셋째, 해외신규시장의 창출 및 신탁관리단체의 저조한 신탁율 제고에도 도움이 될 것이다. 현재 저작권 시장은 포괄적 대리로 인하여 시장의 혼란과 왜곡의 발생으로 일부 신탁관리단체들은 심각한 경영난을 겪고 있다. 따라서 저작권 시장의 왜곡과 혼란을 바로 잡기 위하여 대리중개업에 대한 현실적인 규제와 감독이 요구된다. 이 점에서 포괄적 대리행위에 대해서는 적어도 저작권신탁관리업과 동등한 수준으로 규제하는 것이 타당하다. 그리고 저작권대리중개업에 대해서 최초 제출한 약관에 변경이 발생하는 경우에는 그 변경된 사항과 약관을 제출토록 하고, 이를 어길 경우 업무의 정지나 영업의 폐쇄 명령이 가능하도록 제도 개선의 검토가 필요하다고 본다.

다국어 초록 (Multilingual Abstract)

The purpose of this paper is to suggest the direction and improvement plan of the Copyright agency or brokerage services to solve the recent controversy surrounding the Copyright agency or brokerage services business. To this end, we analyze the current status of Copyright agency or brokerage services, related laws and precedents, and examined the practical issues of agency or brokerage based on the actual condition of copyright trust management organizations. First, some agency or brokers have simply signed a trust business in the category of trust management business and have concluded a comprehensive rights delegation contract with the copyright holder. Therefore, we examined the concrete meaning of ‘case of comprehensive representation’. In addition, because of the inconvenience and inefficiency of members due to the order of the Ministry of Culture, Sports and Tourism, which suspends agent brokerage business to the copyright trust management organization, the problem of concurrent agency or brokerage services by the trust management group and rational solutions Respectively. When a copyright trust management organization conducts proxy brokerage services, there are various advantages as follows. First, since the trust management organization has a copyright holder as a member, the user can solve the difficulty of finding a right holder for permission to use. Second, the proxy intermediation by the trust management group can reduce the copyright infringement ultimately, besides the convenience of the license. Third, it will help to create new foreign markets and improve the trust rate of trust management groups. Currently, the copyright market is confused and distorted due to comprehensive representation, and some trust management organizations are facing severe management difficulties. Therefore, real regulation of agency or brokerage services is required to correct distortion and confusion of copyright market. It is reasonable to regulate the comprehensive agency act at least at the same level as the copyright trust management business. In the event of a change in the terms of the original submission of the copyright agency or brokerage service business, the revised terms and conditions should be submitted, and if it is violated, review of the system improvement should be made to suspend the business or to close the business.
