교통과태료 및 범칙금제도의 합리적개선을 위한 비교고찰 = Comparative Study on The Rational Betterment of Traffic Fines and Penalty System

국문 초록 (Abstract)

생산성과 경제성, 시간 관리의 합리성을 강조하는 형태로 라이프스타일 변화함에 따라 자연스럽게 보다 효율적인 교통수단에 대한 필요성과 욕구는 매우 자연스러운 현상이고, 이는 현실에서 차량보유대수의 증가, 도로환경 지속적 확충과 개선 등으로 반영되고 있다. 이러한 변화는 부정적 효과도 야기하고 있다. 교통사고의 일상화는 물론 대형화하고 더 위협적인 형태로 변모하고, 나아가 이전에 생각하기 어려웠던 새로운 유형의 위험요소로 진화하여 시민의 일상생활을 위협하고 있다. 따라서 교통환경(가장 핵심적인 육상도로교통을 중심으로)에 대한 일정한 규제가 필요하고 그러한 규제는 실효성을 확보하기 위하여 강제적 제재수단을 요구하게 된다. 현행 도로교통법은 교통안전을 확보하기 위한 제재수단으로 형벌과 함께 과태료와 범칙금을 규정하고 있다. 제재수단으로서의 위하효과와 별개로 중심적 역할은 과태료와 범칙금이 수행하고 있다. 그렇다면 이들 제재수단이 기대되는 역할을 잘하고 있는가? 답변은 긍정적이 못하다. 경찰이 집계한 공식통계로 보면 감소추세에 있지만 여전히 높은 교통사고발생율에 대한 지적은 이를 반증한다. 행정질서벌인 과태료와 달리 범칙금은 법적 성격과 함께 부과요건 및 절차나 효과 등에서 구별되기는 하지만 금전적 제재라는 속성에서 양자는 일치하고 이들이 갖는 위법행위에 대한 저지효과는 결국 적정한 금전적 부담을 부여하는지에 의해 결정된다. 이하에서는 교통법규 위반행위에 대한 주된 제재수단인 과태료와 범칙금제도의 운용실태와 문제점을 검토하고 미국 등 주요국가의 유사제도와 비교하여 살펴보되 과태료와 범칙금의 적정수준을 중심으로 그 개선방안을 제시하도록 한다.

in according to the change of life style that emphasize productivity, economy, rationality of time management, it is a natural phenomenon that we need more convenient and effective transporting method. so this phenomenon is reflected on real life with growth of number of vehicles that individuals have, improved environment of traffic roads, etc. but this change has made some negative effects in our life, too. for instance, traffic accidents have been evolving to more large size, more threatening types, and became a new and more serious danger-elements in citizen’s life. so we need a established regulations and disciplines in traffic environment, and sometimes, we need forcible method like as sanctions to secure practical effects of traffic regulations. today, in the Road Traffic Act, traffic fines and penalty system is prescribed as a sanction against violation of traffic regulations with criminal punishment. and as a sanction against violation of traffic regulations, traffic fines and penalty system plalys a central role, comparing with criminal punishment. but the effect of traffic fines and penalty system is not so positive. according to police statistics of traffic, although the rate of traffic accident is decreasing, the violation rate of traffic regulation and accidents is higher than any other countries of OECD. in this study, the actual condition & problems of traffic fine and penalty system thatplays a central role against violation of traffic regulation is reviewed, comparing with that of United States of other countries, especially related to the rational level of traffic fines and penalty that could guarantee the compliance of traffic regulations.
