다중밀집행사에 대한 영국경찰의 안전관리 시스템에 관한 연구 = A Study on the Safety Management System of the UK Police for Mass Events

국문 초록 (Abstract)

이 연구의 목적은 영국경찰의 다중행사(행진 및 집회) 관리와 관련된 주요 특징을 한국과 비교하여 관련 법령 및 제도 개선 방향을 모색하는 것이다. 다중행사 관리와 관련, 첫째, 다중행사 관련법의 경우 영국은 공공질서법과 경찰,범죄,양형및법원법에 체계적으로 규정되었으나, 한국은 집회 및 시위에 관한 법률 이외 다양한 법률이 혼재되어 있다. 둘째, 영국은 공공질서법에 정부(내무부), 자치단체, 경찰의 다중행사 관리의 권한과 책임을 명확히 규정하였다. 한국은 집회 및 시위에 관한 법률에는 국가경찰관서장의, 경찰법에는 자치경찰의 사무로 다르게 규정한다. 셋째, 영국은 다중행사 주최자가 경찰서, 시의회 웹사이트, 이메일 또는 직접 방문 등 다양한 방법으로 신청서를 제출한다. 한국은 경찰에 직접 신청해야만 한다. 넷째, 영국은 다중행사의 주최자, 질서유지인, 안전관리자, 경찰의 역할을 명확하게 규정하였다, 한국은 분명하지 않다. 다섯째, 영국 경찰법은 경찰이 다중행사 관련 특별서비스를 제공하는 경우 주최자는 그 비용을 부담해야만 한다, 한국경찰은 신고대상이 아닌 경우 경찰권을 발동할 수 없다고 주장한다. 여섯째, 영국은 다중행사 주최자, 경찰, 시의회가 협력관계를 유지하고 행사계획을 조정한다. 한국은 경찰관서장의 재량이다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to find ways to improve related laws and systems by comparing the main characteristics related to the management of multiple events (assemblies and processions) by the UK police with those of Korea. Regarding multi-event management, comparing the UK and Korea. First, in the case of multi-event related laws, in the UK, they are systematically stipulated in the Public Order Act and the Police, Crime, Sentencing and Court Act, but in Korea, there are various laws other than the Assembly and Demonstration Act. Second, regarding the management of multiple events, the British Public Order Act clearly stipulates the authority and responsibility of the government (Home Office), local governments, and the police. In Korea, the Assembly and Demonstration Act is the responsibility of the head of the National Police Agency, and the Police Act stipulates the responsibility of the local police. Third, in the UK, multi-event organizers can submit applications in a variety of ways, such as at the police station, on the City Council website, by e-mail or in person, but in Korea, the application must be submitted in person. Fourth, the UK has clearly defined the roles of organizers, order keepers, safety managers, and police of multi-events, but Korea is not clear. Fifth, the UK Police Act stipulated that the organizers should bear the cost when the police provided special services related to multi-events, but the Korean police argued that they could not exercise their police authority if they were not subject to report. Sixth, in the UK, event organizers, the police, and the city council maintain cooperative relationships and coordinate event plans, but in Korea, the chief of police has discretion.
