도로교통법의 실제 적용상 문제점에 관한 연구 = 운전자 행위규제 규정을 중심으로

국문 초록 (Abstract)

본 논문은 도로교통법상 운전자 행위규제 규정의 실제 적용 과정에서 발생한 문제점을 연구하였다. 그 문제점으로 먼저 도로교통법에서 운전자 행위가 경합적으로 규제하는 경우에 이를 어떻게 해결한 것인가. 구체적 사안별로 문제를 살펴보았다. 다음은 운전자의 행위를 일정한 경우에는 법으로 허용하고, 반대로 법으로 금지하는 경우가 존재하고 있다. 이를 어떻게 해결할 것인가. 또 불명확한 법령으로 운전자 행위를 규제 하고 있는 경우에는, 법 집행권자의 자의적으로 판단으로 법을 적용할 소지가 있는 사안에 대해서도 고찰하였다. 위와 같이 법 규정의 실제 적용으로 인하여 부당하게 운전자의 권리가 침해될 가능성이 존재하기 때문에 법 규정의 체계적인 정비가 요구된다.

다국어 초록 (Multilingual Abstract)

This study researched into problems in light of applying the ordinances of regulating drivers' behavior in the Road Traffic Law. The purpose of this study is to consolidate the legal system so that there cannot be a case that people undergo disadvantage due to the wrong application of the Road Traffic Law. First of all, it specifically examined which ordinance would be preferentially applied given violating this in a case that a driver's one behavior is banned doubly by the law in the article of the individual law in each, regarding the problem in light of application. Also, even the problems were specifically examined in a case of being permitted on the one hand and prohibited on the other hand by the ordinances and in a case that ordinances are collided. In addition, the regulation of the law is prescribed indefinitely, thereby having even a basis of a problem that the legal executor would apply the law arbitrarily. This case was examined centering on the application of the ordinances for the Road Traffic Law. Consequently, in order to solve problems in light of applying this law, there is necessity of clearly establishing the standard for application of the law. Thus, there shouldn't be a case that people's right is violated owning to the wrong application of the law, through consolidating the ordinances.
