오늘날 인공지능 기술의 비약적인 발전은 소비자계약의 체결 및 이행 과정에까지 영향을 미치고 있 다. 특히 소비자가 디지털 어시스턴트(digital assistant)를 통해 상품이나 서비스를 탐색하고 자동화된 방식으로 계약을 체결하는 사례가 증가함에 따라 기존 소비자법이 전제로 삼고 있는 인간 사이의 계 약 모델에 변화가 필요한 상황이다. 즉 계약 체결의 당사자, 행위의 귀속, 정보제공의무의 존속 등 다 양한 법적 쟁점들이 새롭게 제기되고 있다.
이러한 배경에서 본 논문은 유럽법 연구소(European Law Institute, ELI)가 2023년 발표한 「알고리 즘 계약에 관한 원칙 및 모델규칙(Guiding Principles and Model Rules on Algorithmic Contracts)」 의 보고서를 중심으로, 디지털 어시스턴트를 활용한 소비자계약에서의 법적 원칙과 규범 구조를 면밀 히 분석해 보았다. 우선 ‘디지털 어시스턴트 행위의 귀속’ 원칙을 검토하여 소비자가 디지털 어시스턴 트를 배치하고 통제할 수 있다면 그 어시스턴트의 계약체결 행위는 소비자 본인의 행위로 귀속됨을 검토하였다. 그리고 디지털 어시스턴트를 통해서 알고리즘 계약이 체결되었다는 사실만으로 소비자의 법적 지위가 약화되어서는 안 되고, 계약 체결 전 단계에서의 정보제공의무는 그대로 존속되어야 함을 강조하였다. 아울러 예측 불가능한 AI 결정, 계약 체결에 있어서 AI의 취약성, 이해 상충 문제 등 다 양한 법적 함의에 대한 ELI 보고서의 접근 방식을 상세히 검토하였다.
향후 ELI의 공통 원칙들이 EU 소비자법의 총칙으로 수용되거나, 개별 입법으로 진행될 가능성이 높으므로 이들 원칙이 디지털 전환 시대에 한국의 소비자보호법 체계에도 중요한 시사점을 제공하고 있다. 특히 전자상거래법상 디지털 어시스턴트의 행위를 어떻게 취급할 것인지와 관련하여 하나의 비교 모델로 검토할 필요성이 있다.

The rapid advancement of artificial intelligence (AI) technology is increasingly influencing the formation and performance of consumer contracts. In particular, as more consumers use digital assistants to search for goods and services and enter into contracts through automated processes, the traditional model of human-to-human contracting assumed by existing consumer law is being challenged. This shift gives rise to new legal questions concerning the identity of contracting parties, the attribution of contractual acts, and the continuing validity of the duty to inform.
Against this backdrop, this paper closely examines the legal principles and normative framework applicable to consumer contracts involving digital assistants, based on the 2023 Interim Report of the European Law Institute (ELI) titled Guiding Principles and Model Rules on Algorithmic Contracts. First, it analyzes the principle of attribution of acts by digital assistants, under which the actions of a digital assistant, when deployed and controlled by the consumer, should be legally attributed to the consumer. The paper further emphasizes that the mere fact that an algorithmic contract has been concluded through a digital assistant must not weaken the consumer's legal position, and that the trader's pre-contractual duty to inform must remain fully applicable. The paper also examines in detail the ELI's approach to various legal implications, such as the unpredictability of AI decision-making, the vulnerabilities of AI in contract formation, and potential conflicts of interest.
As the ELI's common principles are likely to be incorporated into the general provisions of EU consumer law or developed into specific legislation, these principles provide meaningful implications for the Korean consumer protection framework in the digital era. In particular, Korea's Electronic Commerce Act should consider the treatment of digital assistants as a comparative model for legal reform.
