This study attempted to analyze the limitations of calculating reconstruction levy according to the Act on Recovery of Excessive Profits from Reconstruction in the recently increasing number of reconstruction projects and the various impacts this has on reconstruction projects. In particular, along with concerns that the reconstruction burden was an excessive burden, a study was conducted to determine whether the reconstruction burden ultimately distributed to each union member was indeed distributed fairly and equitably. Through this, the main purpose was to identify problems with the reconstruction fee system and seek solutions.
To this end, we reviewed related previous research, analyzed literature and legislation, and analyzed empirical cases and simulations for reconstruction project areas to identify and solve problems.
The main contents of this study regarding the reconstruction levy are as follows.
First, the reconstruction charge is very similar in purpose, nature, and calculation method to the development charge of the development profit recovery system, which was the basis of the reconstruction charge system, but there are differences in the degree of the actual burden, raising concerns about equity and balance. Accordingly, this study looked at the problems through a literature analysis of similar systems and an empirical analysis of reconstruction project areas in Seoul, where reconstruction levies were recently scheduled to be imposed, and proposed solutions from various aspects. As a result of the analysis, the reconstruction levy is a burden that is difficult to accept in certain regions. This is due to the fact that the excess profit calculation method, which is the basis for calculating the levy, is low in fairness and balance compared to similar systems, and can be reasonably improved through practical alternatives. Needs to be.
Second, in reconstruction projects, the reconstruction burden is ultimately distributed and borne by individual union members. In other words, the total amount of reconstruction levies for each project site determined at the time of completion is distributed according to the net profit distribution ratio for each member and is finally borne. The net profit distribution ratio for each member is calculated based on the housing price at the start and end of the publicly announced apartment price, and the publicly announced apartment price used shows problems with objectivity and fairness due to distrust of the publicly announced price, including the recent rapid increase in objections. there is. Problems with publicly announced prices lead to problems in calculating reconstruction levies, causing serious damage to individuals' property rights. In this study, through analysis of empirical case studies of reconstruction in major residential areas in Seoul as well as in the Gangnam and Seocho areas, which are major reconstruction project sites in Seoul, we compare and review distribution through publicly announced prices and distribution through appraisal amounts, and compare and review housing prices at the start and end points. It was confirmed that there was a problem with fair distribution and equity in all housing prices, the causes of the problem were reviewed, and the introduction of an appraisal method was proposed as a solution.
Maintenance projects are a useful means of supplying quality housing. By analyzing the impact of reconstruction levies on the overall business, we seek balance between similar laws and systems, ensure equity and fairness, and stabilize real estate prices by improving the system in the current real estate market, which is suffering from serious side effects due to a lack of supply of new apartments. We hope to achieve the goals of healthy development of the national economy and social integration.
