국문 초록 (Abstract)

최근 개인정보 보호의 중요성이 커짐에 따라, 등기절차에서 개인정보 노출을 최소화하기 위한 법적·제도적 변화가 진행되고 있다. 등기부등본에 기재된 주소 등이 범죄에 악용되는 사례가 늘면서, 대법원은 등기기록상 개인정보 보호 강화를 위한 연구용역을 발주하고 관련 법령 개정을 추진하고 있다. 주된 논의 방향은 등기부등본 열람 시 개인 주소의 일부 또는 전체를 비공개하는 것이다. 이는 범죄 예방에는 효과적이지만, 소송 진행 시 피고 특정 등 실무적 혼란이 발생할 수 있다는 우려도 제기되고 있다. 이러한 논쟁은 개인정보 보호와 공시 의무 사이의 균형점을 찾는 중요한 과제이다.
이러한 문제에 대응하기 위해 일본은 이미 부동산등기법과 상업등기규칙을 개정하여 가정폭력 피해자 등의 주소를 비표시하거나 공시용 주소를 대체하는 조치를 마련하였다. 우리나라 또한 소송관계인의 생명이나 신체에 위해가 우려되는 경우, 법원의 결정으로 주소 등 개인정보가 당사자와 제3자에게 공개되지 않도록 보호조치를 내용으로 하는 개정 민사소송법과 민사소송규칙이 2025. 7. 12.부터 시행되었다. 이는 가정폭력 및 범죄피해자가 소송절차에서 신변 안전을 확보하며 자신의 권리를 주장할 수 있게 됨을 의미한다.
결론적으로, 2025. 1. 31. 미래등기시스템 도입과 함께 개인정보 보호 강화는 필수적인 사회적 요구이며, 디지털 시대에 맞춰 개인의 안전을 보장하면서도 등기절차의 효율성을 유지하기 위한 노력의 일환인바, 일본의 입법례와 2025. 7. 12. 시행 우리나라 개정 민사소송법 등을 참고하여 등기사항증명서의 주소 공시제한을 내용으로 하는 대법원규칙의 개정을 제안한다.

다국어 초록 (Multilingual Abstract)

The rising significance of personal information protection has spurred legal and institutional changes to minimize data exposure in real estate registration or corporate registration. With the increase in crimes misusing addresses from certified copies of the real estate or corporate register, the Supreme Court is commissioning research and preparing law revisions. The main goal is to limit the disclosure of personal addresses—partially or completely—when the register is viewed. While effective for crime prevention, this raises concerns about practical difficulties, such as identifying defendants in lawsuits, making the task one of balancing personal protection with public notice obligations.
To address this, Japan has already amended its relevant laws to allow non-display or substitution of addresses for victims of domestic violence. Similarly, South Korea's amended Civil Procedure Act and its rules, effective July 12, 2025, enable courts to order protective measures—like non-disclosure of addresses and other personal details—when the safety of a party in a lawsuit is at risk. This ensures that crime victims can pursue their rights while securing their personal safety.
Ultimately, with the introduction of the Future Registration System on January 31, 2025, strengthening personal data protection is vital. Following the precedents of Japan and the newly effective Korean Civil Procedure Act, a revision to the Supreme Court Rules is proposed to restrict the public disclosure of addresses on the Certificate of Registered Matters, aiming to maintain registration efficiency while enhancing safety in the digital age.
