군사정보의 공개 및 보도 제한의 적법성 연구

다국어 초록 (Multilingual Abstract)

This paper analyzes Korean military's restrictions on the media in terms of the Constitutional jurisprudence. When the military and the media meet during a conflict as well as a peace clashes are inevitable. The press wants freedom, and the military wants control. Even though the military has an overriding self-interest in getting its overwhelmingly positive story out, it sees no reason to cooperate with the media for its own survival as well as for the people's right to know. But, Korean military has been using various legal mechanism, such as the military secrets protection act and the national defense public information rules, to deny the press access to military informations. The military secrets protection act is in hot debate concerning its arbitrary definition and classification of the military secrete. The national defense public information rules have badly flawed clauses against the Constitution.
