지적재조사사업에 따른 경계 설정 개선 방안 연구 = A Study on the Improvement of the Boundary Setting according to Cadastral Resurvey Project

국문 초록 (Abstract)

지적재조사사업은 토지의 실제 현황과 일치하지 아니하는 지적공부(地籍公簿)의 등록사항을 바로 잡고 종이에 구현된 지적(地籍)을 디지털 지적으로 전환함으로써 국토를 효율적으로 관리함과 아울러 국민의 재산권 보호에 기여함을 목적으로 하는 국가적 사업이다. 그러나 현행 지적재조사사업에 따른 경계 설정 방식은 대부분 토지소유자 협의를 기반으로 한 합의 경계 중심으로 이루어지고 있다. 이에 따라 경계결정의 객관성과 장기적인 경계 안정성 확보에 한계가 있어 토지 소유권 보호에 문제가 제기되고 있다. 특히 지적재조사사업이 완료되었음에도 불구하고 일부 지역에서 토지경계 분쟁이 재발하는 문제점이 나타나고 있다. 본 연구는 독일의 토지경계 관리 방법, 특히 Grenzfeststellung을 분석하고 이를 토대로 우리나라 지적재조사사업의 경계 설정 문제점과 개선 방안을 제시하고자 한다. 연구 결과 경계 확정 방법의 도입과 행정기관 중심의 경계결정 체계, 그리고 지속적인 토지경계 관리체계 구축이 필요함을 확인하였으며, 지적재조사사업의 경계 설정 제도 개선을 위한 정책적 시사점을 제공하였다.

Cadastral Resurvey Project is a national project that aims to efficiently manage the state and contribute to the protection of people’s property rights by modifying the registration of cadastral records that do not match the actual state of the land and converting paper-based cadastral records into a digital cadastral system. However, most of the boundary-setting methods according to the current cadastral resurvey project are centered on consensus boundaries based on landowner consultation. As a result, there is a limit to the objectivity of boundary determination and securing long-term boundary stability, raising problems in the protection of land ownership. Notably, land boundary disputes have been resurfacing in certain areas even after the completion of resurvey projects. This study analyzes German land boundary management methods, specifically Grenzfeststel- lung, to identify problems and propose improvements for Korea’s cadastral resurvey project.
The research results confirmed the need for the introduction of boundary confirmation methods, an administrative agency-centered boundary determination system, and the establishment of a continuous land boundary management system. Furthermore, this study provides policy implications for improving the boundary setting system of the cadastral resurvey project.
