지적국정주의의 의미에 대한 고찰 = A Study on the Meaning of the Principle of National Control in the Cadastre

국문 초록 (Abstract)

본 연구는 지적국정주의를 지적공부 등록사항에 대한 국가의 최종 결정 권한이라는 관점에서 파악하고, 그 의미를 구조적으로 재검토하는 것을 목적으로 한다. 기존 논의는 지적국정주의의 핵심을 국가의 결정 권한으로 파악해 왔으나, 그 권한의 필요성과 책임 구조에 대해서는 충분히 해명하지 못하였다. 이에 본 연구는 지적국정주의를 지적제도에서 토지 표시의 조사‧등록‧공시‧정정이 이루어지는 과정 속에서 검토하였다. 그 결과 지적국정주의는 지적공부 등록사항에 대한 국가의 최종 결정 권한과 그에 수반되는 책임 구조를 함께 포함하는 이념으로 이해되어야 함을 확인하였다. 또한 이러한 재검토는 지적제도의 변화와 개편을 검토할 때에도 국가의 최종 결정 권한과 책임 구조의 유지 여부가 중요한 판단 기준이 됨을 시사한다. 본 연구는 문헌 검토를 바탕으로 지적국정주의의 의미를 재정리한 시론적 연구라는 점에서 의의를 가진다.

This study aims to structurally reexamine the meaning of the Principle of National Control in the Cadastre by understanding it as the State’s final authority over matters recorded in the Cadastral Register. Previous discussions have generally identified the core of this principle as the State Determination Authority, but have not sufficiently explained the grounds for its legitimacy or the accompanying Responsibility Structure. To address this issue, this study examines the Principle of National Control in the Cadastre within the processes through which land information is investigated, registered, disclosed, and corrected in the Cadastral System. The study finds that the Principle of National Control in the Cadastre should be understood as encompassing both the State Determination Authority over matters recorded in the Cadastral Register and the Responsibility Structure that accompanies such authority. This reexamination also suggests that, when considering changes or reforms in the Cadastral System, an important criterion lies in whether the State Determination Authority and its corresponding Responsibility Structure are maintained. This study is significant as a preliminary inquiry that reorganizes the meaning of the Principle of National Control in the Cadastre based on a review of the relevant literature.
