사립학교법과 기독교 사학 - 사립학교의 자율성과 정체성을 중심으로 - = Private School Law and Christian Private school: Focusing on autonomy and identity of Christian private schools

국문 초록 (Abstract)

본 소고에서는 그동안 개정된 사립학교법의 특징과 방향을 살펴보면서 최근 개정된 사립학교법에서 발견되는 문제점을 비판적으로 분석하고자 한다. 사립학교법은 공공성과 자율성에 근거하여 개정되었지만, 사립학교의 자율성보다는 공공성 강화에 더 치우치고 있다. 이로 인한 문제점을 살펴보면서 이에 대처하는 대응 방안을 제시하고자 한다. 2021년 개정된 사립학교법은 공공성 확보 차원에서 공영화 추진으로 일관되고 있어 문제시된다. 이러한 공공성 강화 및 공영화 추진 정책은 여러 문제점을 드러낸다. 첫째, 종교계 사립학교를 포함한 기독교 사립학교의 자율성을 제한하고, 둘째, 기독교적 정체성을 약화시켜 학교의 건전한 발전을 저해할 수 있는 부작용을 초래한다. 셋째, 모든 사립학교에 대한 일률적 규제로 인해 사학이 가진 장점, 즉 특수성과 자주성, 다양성이 속박당하면서 우수 사학의 자주성이 침해되고 교육력 저하를 초래하게 될 가능성이 크다. 바람직한 사립학교법의 방향은 사학의 자율성과 공공성이 서로 상반관계가 아니라 상호보완적 관계로 보아야 한다. 사학의 공영화가 아니라 우수 사학이 특수성과 자율성을 자발적이고 창의적으로 구현할 수 있도록 환경을 조성하는 것이 더욱 합리적이고 효율적인 방식이다. 기독교 학교 스스로 다른 사립학교나 공립학교보다 더 높은 윤리적 책임 의식을갖고 수준 높은 윤리강령을 마련하여 실천해야 한다. 아울러 기독교 학교의 정체성을 수호하기 위해 교회가 관심을 갖고 교단 차원을 넘어 교계 전반과 한국교회 전체로 확산시켜 협력 방안을 모색해야 한다. 또한 바람직한 사립학교법 개정을 위해 다양한 연구 및 사업을 적극적으로 진행할 필요가 있다.

다국어 초록 (Multilingual Abstract)

In this paper, I intend to critically analyze the problems found in the recently revised private school act while examining the characteristics and direction of the Private School Act that has been revised so far. ThePrivate School Act was revised based on publicity and autonomy, but it is more focused on strengthening publicity than on the autonomy of private schools. I want to investigate these problems and suggest an effectivecounterplan toward this. The private school act revised in 2021 collectivized consistently in order to retain it’s publicity. We can find many problems in these reinforce policy of collectivization and publicity. First, there are problems that would limit the autonomy of christian private schools, including the religious private schools. Second, this law cause christian identity of the christian private school to be weaken and then obstructs healthy development. Third, regulation which applied in all cases give rise to infringement toward the autonomy of the excellent private school and cause to decline of the educational power. Because this law restrains the distinct characteristics and independence and diversity of these schools. In order to establish a desirable direction of this law, we must consider autonomy and publicity of the private school not competing but complementary relation. The more reasonable and effective solution is not collectivization but creating an creating an atmosphere in which the excellent private school can realize with their distinct characteristics and independence voluntarily and creatively. And also christian private school themselves prepare code of ethics with more higher ethical responsibility than other private school or public school. To protect the identity of the christian private school, churches take an active interest in this problem, and need to effort of cooperative plan spreading the whole of Christianity beyond religious body. To revise of reasonable private school act, we must unfold various research and works positively.
