롤즈(J. Rawls)의 정치적 정의관에 내재되어 있는 배경적 정의질서: 구성개념을 중심으로 = Background Justice-Order entailed in Rawls` Conception of Political Justice: A Focus on Its Conceptual Constituents

This essay is to clarify the content as well as the features of background justiceorder entailed in Rawls’ conception of political justice. Background justice-order, as the order in the first justice circumstances, secures the just background conditions for the fundamental social orders through the basic structure of society. Moveover, it prevents the interpersonal and material transactions between the citizens as well as the associations from becoming gradually degraded into unjust ones in the course of time. This essay consists of discussions about the conceptual constituents of background justice-order: They are about the eligible order-subjects along with the just order between them; about the just way in establishing fundamental social orders; and about the characteristics of just jurisdictional power in the established orders. They are focused especially upon the following issues that are addressed or explained not in a clear enough way in Rawls’ discussions: First, upon the just order between the eligible order-subjects; second, upon the relationship as well as the differentiation between “agreement as an actual social contact” and “hypothetical social contract,” both of which are suggested at the same time in Rawls’ discussion; third, as the same kind issue as in the second one, between “authority” which is correlated with willing compliance and “coercive political power” which is the correlative of the coercive subjection. Finally, this essay, based on the above discussions, attempts to map out the outlook of how the background justice-order infiltrates into social orders all over and is incorporated into the social order-system in a consistent way.
