집회ㆍ시위에 대한 민간경비 대응방안 = Private Security Response methods against Demonstrations and Protests

Demonstrations and protests are the right for civil liberties guaranteed by the Constitution, and the most basic activities for people’s demanding something from the country.
People have been demonstrating since 2000s. This is because people would like to achieve what they want through demonstrations and protests, but those things have not been always done in a peace manner.
For that reason, sometimes police are hurt while they try to stop demonstrations, and properties around the street are damaged by the violent demonstrations and protests. It is because demonstrators are willing to get public attention from normal citizens and appeal to the government to get something they want. Consequently, police are trying to enforce a law strictly to the demonstrators.
Recently, when it comes to the style of demonstrations and protests, people create modified and astute demonstrations and protests. For instance, there are many modified demonstrations and protests such as a car protest and a single person demonstration that demonstrators utilize cunningly.
Generally, police have been used law enforcement authorities such as dispersal and suppression, but private security has many limitations to the dispersal of protests because it is just a private organization without any governmental authorities. Therefore, this study has analyzed legal solutions to demonstrations and protests from the private security’s point of view.

국문 초록 (Abstract)

우리나라의 현대사를 살펴보면, 짧은 시간에 민주화를 이룩하게 된 가장 큰 원인 중에 하나가 바로 집회ㆍ시위로 민주주의 열망을 달성하였다는 것이다. 집회ㆍ시위는 헌법에서 보장하고 있는 자유권이자, 일반인들이 원하는 것을 국가에 요구하는 가장 기본적인 활동 중에 하나이다.
그러나 2000년대에 들어와 다시금 많은 사람들이 집회ㆍ시위를 실시하고 있다. 그러한 원인으로는 자신들이 원하는 것을 이룩하기 위함인데, 이들의 집회ㆍ시위가 항상 평화적인 방법에 의해 이뤄지고 있는것은 아니다.
최근의 집회ㆍ시위는 주변의 사람들이 다치거나, 기물이 파손되는 등 폭력적인 형태의 집회ㆍ시위가 종종 발생하고 있다. 이러한 원인으로는 자신들이 원하는 것을 이룩하기 위한 하나의 방법으로 일반시민들에게 주목받거나, 관련기관에 어필(appeal)하기 위함으로 보여진다. 또한 기존의 폭력적인 형태의 집회ㆍ시위에서 더 발전하여 보다 지능적인 형태의 변형 집회ㆍ시위를 벌이고 있다. 변형 집회ㆍ시위는 1인 시위, 차량시위 등과 같이 집회ㆍ시위 관련법을 교묘하게 악용하는 사례가 빈발하고 있는 것이 지금의 상황이다.
이러한 집회ㆍ시위의 경우 해산 및 진압과 같은 공권력 행사를 중점적으로 사용하였으나, 민간경비원의 경우 사인(私人)의 지위이기 때문에 집회ㆍ시위 해산에 많은 제약조건이 따르고 있다. 따라서 이러한 문제에 대해서 공권력을 가지지 않고 있으며, 영리성을 추구하는 형태의 민간경비의 입장에서 집회ㆍ시위의 효과적인 해결방안을 살펴보았다.
