다국어 초록 (Multilingual Abstract)

Professor Han Tae-Yon is one of the leading constitutional law in the beginning stage of the korean constitutional history. He brought theories of the people's sovereignty, decision-theory, democracy and fundamental rights of a natural character into the arena of the korean constitutional discourse. In this way he contributed to widen the horizon of the constitutional knowledge in the 50s and 60s. He also presented his views about the pending issues in terms of the constitutional criterion to enhance the explaining ability of the constitutional law about political and social affairs. These activities also contributed to enlighten the people's consciousness about the constitutional law. From the 60s on he dedicated himself to the real political activities. In this position he tried to make concrete his ideas into the work and explain the constitutional reality according to his ideas. For this reason he can be entitles to be a pioneer of the korea constitutional theory. Notwithstanding it was neglected to throw the eyes to his academic achievements.
This article aims to describe the very early stage of the constitutional theory in term of his academic achievements. He on the one hand presented the universal value accumulated in the western constitutional history to us. On the other hand these values were, however, subject to the concrete circumstances, so that the constitutionals law came to lost the own independency. This tendency emerged especially in the late 60s. The exceptional circumstances made weak the rule of law in formal sense as well as the natural character of the fundamental rights in their effect. The component of the rule of law in the constitutional law was subject to the state object which arbitrarily set up by the state power. From the theoretical point of view the mythological character of the people's sovereignty was abandoned, and substituted by the political and arbitrary decision of the circumstances. In this way the methodology to establish the stable constitutional theory in the dynamic circumstances was lost. Instead, the real constitutional policy came to dominate in the political arena.
