建筑作品的范围争议与辨析 = Dispute and Discriminate on Scope of Architectural Works

With the architectural works become the type of works protected by copyright law in China, theoretical and judicial circles began to pay attention to the copyright protection of architectural works. It is of great significance to define the scope of architectural works, It is not only related to the judgment of architectural works, but also related to the judgment of the content of copyright rights of architectural works, and then related to the judgment of the copyright infringement of architectural works, and finally related to the protection of the copyright of architectural works. The theoretical and judicial circles in China have disputes over the definition of the scope of architectural works. There are different understandings and formed different views. However, different understandings and different viewpoints have brought difficulties to the copyright protection of architectural works, leading to the differences in the copyright protection of architectural works in judicial practice. This paper aims at sorting out the disputes and different viewpoints and discriminating them, so as to settle the relevant disputes and unify the viewpoints, so as to promote the unification of the copyright protection of architectural works.

随着我国《著作权法》将建筑作品明确为保护的作品类型后，理论界 和司法界开始关注建筑作品的著作权保护问题. 建筑作品范围的界定具有 重要意义，不仅关系到对建筑作品的判定，也关系到建筑作品著作权权 利内容的判定，进而也关系到侵犯建筑作品著作权行为的判定，并最终 关系到对建筑作品的著作权保护. 我国理论界以及司法界对建筑作品的范 围界定存在争议，有不同的理解并形成了不同的观点，而不同的理解和 不同的观点给建筑作品的著作权保护带来了困境，导致了司法实践中对 建筑作品著作权保护的差异. 本文旨在梳理争议和不同观点，并进行辨析， 以期对解决相关争议、统一观点，促进对建筑作品著作权保护的统一.
