신성 로마제국의 권력기관과 직위에 관한 연구 = A Study on the Power Organ and Office of the Holy Roman Empire

국문 초록 (Abstract)

신성 로마제국은 서부와 중부의 유럽에서 다수의 민족의 복합체로서 존재했던 거대한 영토의 제국이었다. 제국은 빠른 중세 동안에 발달하기 시작했고 1806년 해체까지 유럽의 주요한 강대국으로서 존재했다. 제국을 구성하는 제도들과 원리들 그리고 권력기관과 직위는 시간이 흐르면서 여러 변화들을 경험하게 된다. 제국에는 작위를 가진 많은 귀족들이 있었고 이들은 자신들의 가문을 형성하면서 가문에 따라서 황제와 다양한 관계를 형성하고 유지했다. 귀족들은 권력기관과 직위를 차지하면서 영토나 영토에 사는 사람들을 지배하며 권력을 행사했다. 제국의 많은 권력기관과 직위는 이제는 소멸된 것들도 있고 지금까지 남아 있는 것들도 있다. 이러한 과정은 지금도 계속하고 있다. 앞으로 미래에 지금의 권력기관과 직위의 일부는 사라질 것이고 때때로 새로운 것들이 생겨날 것이다. 국가와 지방행정에서 권력기관과 직위 그리고 이것들의 기능은 시간과 장소에 고정되어 있지 않다. 시간이 흐르면서 그리고 장소가 바뀌면서 사람들은 끊임 없이 새로운 변화를 모색하고 추구할 것이다.
신성 로마제국으로 뒤돌아보면 생소한 이름의 많은 권력기관과 직위를 발견할 수 있다. 제국의 권력기관과 직위의 구조와 기능이 어떠한지 그리고 권력기관 사이의 상호관계가 어떠한지는 여러 연구자들의 관심의 대상이 되어 왔다. 제국의 권력기관과 직위의 기능과 이것들의 정착, 변화와 소멸 그리고 더 나아가 새로운 모습으로의 재등장을 연구하는 것은 역사의 연구를 넘어서 유익한 일일 것이다. 권력기관과 직위들을 계속하여 탐색하고 그 결과물을 활용하는 것은 국가발전의 촉진을 위하여 필요한 일이기 때문이다. 권력기관과 직위의 개발과 변화는 법과 사회의 변화와 밀접하게 관련되어 있다. 또한 권력기관과 직위는 그 당시의 정치적 상황을 반영하기도 한다. 본 논문은 제국의 권력기관과 직위에 관하여 풍부한 내용을 담고 있는 금의 칙서와 1648년에 제국의 황제와 프랑스 사이에서 체결된 베스트팔렌 조약을 주요한 연구자료로 삼고 있다. 양 문서들은 제국에 관한 연구에서 1차적인 자료로서 중요한 의미를 가지고 있기 때문에 양 문서들에 관하여 해석을 시도했다.
본 논문은 포크트의 의의와 기능, 포크트의 사법기능, 포크트의 종류, 제국의 다양한 궁정 직위들, 궁정 직위의 겸직 현상, 베스트팔렌 조약 전문의 다양한 직위들, 제국의 권력구조로서 원의 존재, 칸츨러의 기능과 종류, 대칸츨러의 의의와 기능, 호위의 문제, 칸츨러와 칸츨라이의 사용례들, 부칸츨러의 의의와 기능을 다루었다. 포크트, 칸츨러의 종류 중에서 대칸츨러, 부칸츨러, 원의 존재를 연구의 소재로 삼은 것은 이러한 기관들이 관심과 흥미를 유발할 수 있는 많은 요소를 가지고 있기 때문이다. 인간은 늘 권력기관과 직위들에 관하여 많은 관심을 가지고 있다. 그 동안의 인간의 꾸준한 노력과 투자의 결과 완전하다고는 할 수 없지만 이것들이 제기하는 여러 문제들을 해결할 수 있는 우리들의 능력은 향상되어 오고 있다.
어떻게 하면 인간이 권력기관과 직위를 잘 구성할 수 있을까? 이것이 본 논문의 기저에 있는 문제의식이다. 본 논문은 권력기관과 직위들에 대하여 역사적 접근을 함으로써 권력기관과 직위에 관하여 좀더 넒은 이해를 제공하는 것을 목적으로 한다. 제국의 권력기관과 직위가 어떠한지 살펴보는 ...

This article has studied the various power organs and offices in the Holy Roman Empire including Vogt, Kanzler, Erzkanzler, prince-elector, interlocking of offices, Reichskreis. This article has also studied the political history of the Holy Roman Empire. The development of the power organ and office reflects the society and political situation.
There are usually the provisions on the power organ and office, the executive power, the power of congress, and the power of courts in the constitutional law and administrative law. There are many provisions on the power organ and office of the Holy Roman Empire in Golden Bull and the treaty of Westphalia. So many legal and political problems have come in the practical history of the power organ and office of the Holy Roman Empire. So the need of study on those subjects, Golden Bull and the treaty of Westphalia in the constitutional law, administrative law, and the political science including the international law has been acknowledged broadly.
Also to improve the understanding and knowledge of those subjects we should study broadly and deeply on those subjects. The study on those subjects is very difficult. The study on those subjects has very important meanings for the function of the state and government including the local administration.
This article has reviewed various aspects about the institution including offices and legal character of the Holy Roman Empire and the related countries, especially including the interrelations between the emperor, estates and territories around the sovereignty. The Holy Roman Empire and Austria or Austrian Habsburg had the unique relations during the their long existence. This article has tried to analyze historically on the power organ and office in the Holy Roman Empire and the Germany. This article has the purpose to give perspectives about those subjects.
