미국의 법학 학문후속세대 양성체계와 시사점-최종학위 취득 이후 과정을 중심으로- = How the U.S. Law Society Prepares the Next Generation of Legal Scholars and Its Implications for Korea

The scholarly mission of the legal education has been under attack by academic critics in the U.S for years. To break through this longstanding controversy in an effective way, the law schools have developed various programs to prepare the next generation of legal scholars. Two examples of the most successful programs are fellowship programs and law centers. Fellowship programs offers mentoring system by law school professors, and entails duties to publish a legal article and to give lectures to law school students. Law centers have enriched the diversity and interdisciplinarity of legal scholarship by conducting research on a broad variety of legal issues in a society in collaboration with other disciplines.
This article studies the examples of fellowship programs and law centers in the U.S. and considers its implications for Korea in terms of two key points: fostering the future legal scholars and characterized legal education in law schools.

국문 초록 (Abstract)

미국 법학계는 실무중심의 로스쿨 체제 내에서 학문후속세대양성을 위하여 다양한 방법을 모색해왔다. 그 중 현재 가장 활발하게 운영되고 있는 프로그램으로는 (박사 후)연구과정제도와 연구센터제도가 있다.
미국 로스쿨의 연구과정제도는 교수법 및 연구방법론의 심화 및 개발을 위하여 학문연구를 목적으로 하는 신진 학자들을 대상으로 개설되었으며, 교수법을 개발할 수 있는 체계적인 과정을 제공하고 있다. 또한 로스쿨 교수진들과의 소통과 지도를 통하여 연구자 자신만의 연구방법을 찾아가는 기회가 되기도 한다. 미국 로스쿨의 연구센터의 경우에는 다양한 법적 쟁점들을 연속성 있게 연구할 수 있는 학제적 연구에 적합한 환경을 조성하는 역할을 수행하고 있으며, 특히 전임연구원 제도 등을 통하여 로스쿨의 학문적 자산을 쌓아나가고 있다.
이 논문은 미국 로스쿨에서의 연구과정제도 및 연구센터제도의 구체적 사례들을 검토하고, 이들 중 한국법학교육의 상황과 취지에 부응할 수 있는 지점들을 찾아보았다.
연구과정제도는 신진 학자들이 전통적인 법학방법론·실무와의 연계성·학제적 연구방법 창출이라는 중첩된 과제들을 풀어나갈 수 있는 안정적인 기반을 제공하고, 교수법 및 교육철학을 체계적으로 발전시킬 수 있는 기회를 제공한다는 측면에서 그 도입을 고민할 필요가 있다.
연구센터의 경우, 로스쿨제도 도입 시부터 강조된 각 학교의 특성화교육을 위한 자원을 마련하고 학생들의 학술연구에 대한 관심과 참여를 끌어낼 수 있다는 점에서 활성화 논의의 의의가 있다.
