The purpose of this study is to examine the current status of the treatment for foreign prisoners and to suggest alternatives for treatment improvement.
We are living in a global era that countries around world interact through many ways and many people live or work in countries different from their original nationalities. As a result, increasing crime activities committed by foreign prisoners in a country have become an important issue.
To manage the situation efficiently and effectively, this study will provide us with useful knowledge theoretically and empirically. First, through literature review, theoretical background on the treatment of foreign prisoners including legalistic status and UN Standard Minimum Rules for the Treatment of Prisoners was examined. Then, questionnairesurvey was implemented to examine the perception of foreign prisoners in Daejeon correctional institution and Chungju women correctional institution for demonstrative research.
Variables examined in the survey are various including demographic characteristics, accommodation, enlightenment, vocational training, medical care, classification, and discipline. That is, issues relevant to foreign prisoners passing procedures after incarceration were surveyed: (1) admission, (2) cell assignment, (3) supply, (4) outside contact, (5) attitude of correctional officers, (6) rehabilitation, (7) vocational training, (8) medical care, (9) classification, and (10) discipline.
Foreign prisoners expressed negative opinions on each procedure of assignment cell assignment, cell capacity, cell space, and cell mates. In purchasing part- the taste of food, variety of purchasing items, purchasing price. In outside contact part - the number of progressive audience, mail inspection, telephone call charges, post stamps charges limitation of telephone calls, opportunity of receiving a media in native language, contact with native citizens. In attitude of correctional officers - the impartiality of operation, authoritarianism of correctional officers, enforcement of security section, disadvantageous on the terms desired. In rehabilitation part - the equilibrium of religious services, opportunity of desired educational programs, computer learning, forced audio-video educations. In vocational training part - an opportunity deficiencies of full time labor. In medical part - an average satisfactory in general. In classification part - an interview with officer in charge of classification. In discipline part - a fairness of punishment procedure, a guarantee of deposition, treatment after punishment etc.
They are suffering from physical deprivation and different weather and culture. At the same time, they have hard time to get information for themselves and have difficultyin understanding the sense of honor or different norms, which incurs them to face deficiencies of communication and make them feel unequal treatment.
In conclusion, this research will be a study for the traditional way of correctional treatment to foreign prisoners to improve considerably. Hopefully, the improvement of foreign prisoners treatment could be fitted to the 21st century rather than the present status.
