국내외 입양 관련 법률 체계와 내용에 관한 비교연구 = A Comparative Analysis of Adoption Law -Focusing on Korea, Japan, Norway, Sweden, U.K.-

국문 초록 (Abstract)

본 연구는 국내외 입양관련법률의 내용을 분석틀에 근거하여 비교하고, 그 결과를 토대로 선진화된 입양제도가 될 수 있도록 구체적 입양법률의 개선방안을 제시하였다. 연구결과 우리나라는 입양 관련 법률이 민법과 입양특례법으로 이원화되어 있었으며 친양자와 특별양자제도를 구분하여 선진국에 비하여 법체계와 입양제도가 복잡한 특징을 보이고 있었다. 법률의 내용에서는 아동의 의견반영 방법을 구체화하지 않았으며 입양부모에 대한 적합성 여부조사에 관하여 규정하지 않았다. 전반적으로 입양배치와 관련내용을 엄격하게 규정하고 있는 선진국에 비하여 관련내용이 부족하였다. 이러한 분석결과를 근거로 선진화된 입양제도로의 개선을 위하여 이원화된 입양법의 정비, 파양예방을 위하여 입양배치에 대한 신중한 검토에 관한 규정강화, 입양절차에서 아동의 의견존중방안을 제안하였다.

The purpose of this study is to suggest the direction of revision for the Korean Child Adoption Law based on the results of a comparative analysis on adoption law between five countries. The main results of this study are as follows: The problems in the legislation and the adoption system mainly occurred due to a dual legislative system and poor adoption systems. And the current legislations does not contain screening for adopting parents and respect of child`s opinion. The law in advanced countries secure sufficient consideration of adoption placement. The suggestions for the improvement of the adoption law and policy is reformation of the adoption law, law enforcement of adoption placement, and respect for child`s view in the adoption process.
