    본 연구는 다음의 몇 가지 명제로 정리할 수 있다.
    첫째, 규제국가는 복지국가 이후 근대국가를 포착하는 개념으로서, 최소국가를 지향하는 신자유주의적 해석만 가능한 것은 아니다. 실제로는 국가의 규제와 그에 참여하거나 협력하는 민간의 규제가 갈수록 늘어가고 있다. 한편, 독일에서는 국가로 부터 자유를 핵심으로 하는 홉스식 자유주의에 기초하는 복지국가를 대신하여 자율 적 시민을 핵심으로 하는 칸트식 자유주의에 기초하는 사회국가가 발전하였는데, 최근 사회국가에서 보장국가로 이행하는 현상은 독일 외의 국가에서 복지국가 이후 규제국가가 등장하는 것과 같은 차원으로 이해할 수 있다. 복지국가에서 수행되는 모든 공공서비스가 규제의 대상이 되는 것과 같이, 사회국가에서 수행되는 모든 생존배려(Daseinsvorsorge)가 보장의 대상이 된다. 그 결과 비교적 최근에 국가와 행정의 임무로 포착된 경제행정과 사회행정뿐 아니라 경찰과 같은 전통적인 질서행 정도 규제와 보장의 관점에서 새롭게 구성될 수 있다. 규제국가와 보장국가는 전자의 경우 규제의 권한에 초점이 맞추어지는 데 반하여 후자의 경우 보장의 책임에 초점이 맞추어지는 점에서 서로 차이가 난다. 이에 따라 보장국가와 달리 규제국가에서는 국가와 행정의 임무가 수행되는 방식의 변화에 그치지 않고 임무의 범위가 축소될 가능성이 있는데, 이는 복지국가와 사회국가의 이념적 기초와 그 지향의 차이에서 비롯하는 결과이다. 참고로, 보편적 현상인 공동규제(co-regulation)가 독일에서 규제 된 자율규제(Regulierte Selbstregulierung)라는 특수한 개념으로 변형되는 이유도 근본적인 점에서는 같다.
    둘째, 우리 학설에서 말하는 규제국가는 이미 발전된 국가에 타당한 것이고, 이와 달리 우리 실무는 발전국가의 전통에 익숙한데, 그 결과 이론과 실무의 괴리가 갈수록 커지고 있다. 이미 발전된 국가도 절대주의 경찰국가 시대에 발전국가로서 전성기를 경험한 적이 있고, 이후 자유주의 근대국가 시대에 전체적으로 국가의 개입이 축소되 기는 했으나 복지국가를 거쳐 지금의 규제국가에 이르기까지 발전 지향적 속성은 계속되고 있으며, 최근에는 신자유주의에 대구(對句)가 되는 신국가주의라는 표현이 사용될 만큼 국가의 소환이 늘어가고 있다. 다만, 자유주의 근대국가 시대에 후견주의 (paternalism)의 극복을 통한 법치주의의 획기적인 신장이 있었기에, 주로 산업 진흥 정책을 사용하는 발전 도중인 국가와 차별되는 발전의 전략을 사용할 뿐인 것이다. 그런데도 규제국가와 발전국가가 양립할 수 없는 것으로 오해하고 규제국가에서는 발전을 추구해서는 안 되는 것처럼 생각하는 경우가 적지 않아 문제가 된다. 예를 들어, 최근 전 세계에서 경쟁적으로 일어나는 인공지능에 대한 국가적 투자는 발전국 가의 전통에서 비로소 이해가 가능한 것은 아니고 규제국가의 전통에서도 얼마든지 이해할 수 있는 현상이다. 여기서 발전국가와 달리 규제국가에서는 법치주의의 요청 이 강한 만큼 법학의 역할이 상대적으로 커지는 점에 주목할 필요가 있다. 역설적이지 만 발전에 관한 행정법이 더 중요한 경우는 발전국가가 아닌 규제국가인데, 발전국가 에서 발전행정이 중요한 것은 당연하지만 그에 대한 법적인 수요는 크지 않을 수 있기 때문이다. 발전국가에서 규제국가로 이행 중인 우리도 발전에 관한 일반행정법 의 대응이 시...

    This study presents the following three propositions regarding the evolution of state models and their legal implications.
    First, the regulatory state, as a conceptual framework for the post-welfare state, is not merely a neoliberal pursuit of a minimal state. Instead, we observe an expansion of state regulation and the oversight of private-sector participation. In the German context, the welfare state-rooted in Hobbesian liberalism-has been superseded by the social state (Sozialstaat), based on Kantian liberalism and autonomous citizenship. The recent transition to the guarantee state (Gewährleistungsstaat) parallels the emergence of the regulatory state elsewhere. Just as public services in the welfare state become subject to regulation, all subsistence services (Daseinsvorsorge) in the social state are now subject to a “guarantee.” While the regulatory state emphasizes the authority to regulate, the guarantee state focuses on the responsibility to ensure service provision. This distinction stems from the differing ideological foundations of the welfare and social states, explaining why universal phenomena like co-regulation manifest specifically as regulated self-regulation (Regulierte Selbstregulierung) in Germany. Second, a significant disconnect exists between academic discourse and practical operation in Korea. While the discourse centers on the regulatory state model of developed nations, practical operations remain tethered to the developmental state tradition. Historically, even developed nations functioned as developmental states during their absolutist “police state” eras. Although state intervention diminished during the liberal modern state phase, the developmental context persisted through the welfare state to the current regulatory state. Recently, “neo-statism” has emerged as a counter-current to neoliberalism. However, because developed nations established the rule of law by overcoming paternalism, their current strategies-such as massive investments in AI-are executed within the regulatory state tradition, demanding rigorous jurisprudence. Paradoxically, developmental administrative law is more critical in the regulatory state than in the developmental state itself. As we transition, an urgent response through general administrative law is required.
    Third, Korea’s unique path-bypassing the liberal modern state stage and failing to fully overcome paternalism-exerts a lasting influence. Consequently, legislation intended to minimize regulation and maximize AI investment (e.g., the Framework Act on Artificial Intelligence) may fail to function as intended when operating under a developmental logic disguised as a regulatory form. To resolve this, we must adopt the dual concepts of “regulation for development” and “development through regulation.” The former describes the adoption of regulatory forms within a developmental state, where regulations often revert to tools for industrial promotion, undermining the rule of law. The latter describes the incorporation of developmental content within a regulatory state, where the strategy shifts toward continuous regulatory innovation. Korea’s stagnation in regulatory reform since democratization stems from this transition: what was once flexible “discipline” has now become rigid “regulation” that demands a level of legal sophistication the current system struggles to provide.
