국문 초록 (Abstract)

오늘날 소년범죄는 날이갈수록 전문화, 지능화 되어 가고있다. 따라서 소년범죄도 해마다 증가하고 있다. 이러한 소년범죄에 대하여는 과거에는 소년과 성인범죄인을 구분하지 않고 동일하게 취급하여 왔지만 소년은 성인범죄자에 비하여 아직 어리고 소년범죄는 성인범죄에 비해 비 의도적이고 덜 계획적이란 점 때문에 소년범죄인을 성인범죄자와 같이 취급하지말고 국친주의 사상과 소년보호의 법이념에 의해서 달리 취급해야 한다는 사상이 대두되었고 그 일환으로 소년에 대한 선도조건부 기소유예제가 대두되었는데 이제도는 한국의 특유한 제도라고 할 수가 있다. 따라서 본논문에서는 소년범죄인에 대한 선도조건부 기소유예제도의 이론적 배경인 소년범죄이론의 개념과 현황을 살펴보고 동시에 소년범죄사건처리절차를 살펴본 다음에 현재 한국에서의 소년조건부 기소유예에 관한 개념과 이론 및 통계등을 살펴 보았다. 그리고 법적, 행정적, 경제학적, 사회복지학적 접근법의 학제적 접근을 통하여 우리나라의 선도조건부 기소유예제도의 문제점을 법무부훈령 제373호인 소년선도 보호지침을 통하여 사견으로 주장하였으며 결론에서는 우리나라의 선도조건부 기소유예제도의 방향을 언급하였다.

다국어 초록 (Multilingual Abstract)

The paper dealt with the meanings and problems of the proper guidance conditional suspension of indicment the juvenile delinguent. These days many juvenile delinguent increased and highly specialized in many fields including classic jucenile delinguent. Thus korean jucenile delinguent is increasing now. These days parens patriae thought and ideology for juvenile delinguent protection was beginning to make their apperance. owing to the difference juvenile delinguent and adult criminals which is essentially different in the degree of the crime intention on deliberation or re-socialization. Thus As link of the parens patriae thought and ideology for juvenile delinguent protection, korean proper guidance coditional suspention of indicment for juvenile delinguent was beginning to make its appearace. Thus in this article, first, we are concerned with juvenile delinguent crime theory and juvenile delinguent care proceding and juvenile delinguent statistics. In conclusion, I asserted the client oriented proper guidance conditional juvenile delinguent including its problems in place of the existing legal, administrative proper guidance conditional juvenile delinguent.
