동양의 의리와 서양의 정의의 비교 = A Comparison between Euri in Eastern Tradition and Justice in Western Tradition

국문 초록 (Abstract)

본고는 주체적 시각에서 민주시민의 자질로서의 동양의 의리와 서양의 정의를 비교하여 상호보완점을 탐색하는 데 있다. 서양의 정의는 공리를 증가시키는 행위, 공정, 권리와 공동선의 분배적 정의가 핵심이다. 동양의 의리는 올바른 도리로서의 의(義)와 도(道), 덕(德), 그리고 서(恕)가 중심개념이다. 자유주자의 대표적인 롤즈의 정의관인 공정으로서의 정의는 일차적으로 사회의 기본구조에 적용되고 그 사회는 질서정연한 사회이며 개인주의적 관점이다. 그의 정의원칙은 이차적으로 개인에게 적용되며 정의원칙은 공정성, 성실성, 그리고 선행에 대한 책무이다. 이에 반하여 동양의 의리는 성의 · 정심(誠意 正心)을 통하여 천리에 따르면 개체적 조화를 이루어 의가 구체화되어 예(禮)가 저절로 실현되는 공동체가 된다는 것이다. 이와 같이 서양의 정의는 사회구조에 일차적 관심을 가지면서도 개인주의 입장이다. 동양의 의리는 일차적으로 자율적 개인에 관심을 가지면서도 공동체주의 관점에 있다. 그 기본적인 차이점은 천리나 인 및 덕과 같은 근본을 먼저 생각하는가 아니면 사익을 먼저 생각하는가에 연유한다. 서양에서 자유주의와 공동체주의의 수렴을 통한 자유민주사회의 이상을 실현하려는 움직임에 동양적 의리의 관념인 남과 나를 같이 생각하는 혈구지도(?矩之道)는 좋은 시사점이 되리라 여겨진다.

다국어 초록 (Multilingual Abstract)

The purposes of this essay are to provide a comparison between 'Euri (truth and right)' in eastern tradition and 'Justice' in western tradition and to explore the possibility of complementation of the two concepts. The central substances of justice are utilitarian behaviors, fairness, rights, and fair distribution of common goods. Meanwhile, Euri" in eastern tradition includes 義(eui), 道(do), 德(deok), 恕(seo) as its central concepts. Justice as fairness presented by Rawls representing liberalism is primarily applied to the basic social structure and the society is assumed as an well ordered and based on individualism. Secondarily, his principles of justice is applied to individual and those principles are fairness, sincerity and responsibility of good deed. On the contrary, Euri in eastern tradition assumes that if one follows the natural law with sincerity and right mind, individuals will accomplish a harmony and build a community in which righteousness is specified and courtesy is realized. "Euri" in eastern tradition primarily gives attention to autonomous individuals but is based on communitarianism. It emphasizes a distinction between whether one follows fundamental principles such as natural law, benevolence and virtues and whether one pursues private interests. ?矩之道(hyul-gu-ji-do), central idea of "Euri" that pursues both oneself and others, provides useful insights for western intellectuals that recently seek an integrative approach that encompasses individualism and communitarianism to realize the ideals of liberalism.
