In keeping with the situation of the times that the rebuilding and redevelopment project is not a choice but a necessity, existing studies have had the great outcome in its theoretical terms. But they have neglected to analyze the problem occurring in its field and take measure for it.
Moreover, in the reality that the dilapidated housing district has become the means for accumulating wealth through the rebuilding and redevelopment project, this study wanted to discuss the progress and tax problems of the rebuilding and redevelopment project overall but presented the statistical data of related departments and the findings due to difficulty in obtaining data. So this study could not realize its original intention considerably.
So this study presented improvements concerning the tax problem related to the rebuilding and redevelopment association improperly treated in the rebuilding and redevelopment project field and the problem of the occupancy of its member.
First, it attempted to investigate the tax problem improperly treated by presenting the case of proportional division of the tax amount in joint purchase related to housing supply of general installment sale(taxation and tax exemption) in returning the value-added tax.
Second, it attempted to discuss the problem of treating the financial loss of general administrative expenses that the rebuilding and redevelopment association commits a mistake in handling by linking it with the value-added tax in its field.
Third, it sought to discuss, in linkage with the comprehensive real estate tax law, the problem of legal equity that can be caused by deeming the whole as one house and applying the same tax rate without distinguishing the right to occupancy of the member of the association into the pure occupancy right and real estate(land) in the transfer income tax field.
This study had difficulty collecting data and previous studies have not elicited the problem and presented improvements. So it failed to discuss the overall problem of rebuilding and redevelopment.
Nevertheless, this study was finished with the anticipation that the study related to the field-and case-centered tax will provide an opportunity to become harmonized the practice and legal theory of the rebuilding and redevelopment project.
