기후대응기금의 효과성과 책임성을 위한 행정법적 과제 = Legal Problems on Effectiveness and Accountability of the Climate Response Fund from the Perspective of the Administrative Law

국문 초록 (Abstract)

기후위기대응은 생존의 문제이다. 이는 더 깨끗한 물이나 공기, 더 쾌적한 환경과 같은 문제 수준을 넘는다. 기후위기대응은 생물학적 측면에서뿐만 아니라 사회경제적인 측면에서도 생존의 문제이다. 기후위기로 인한 홍수, 가뭄 등 자연재해에서의 생존만 문제되는 것이 아니다. 탄소중립 사회로의 이행에 뒤처지는 온실가스 다배출 산업구조는 더 이상 살아남기 어렵다. 또한 탄소중립 사회로 이행하는 과정에서 발생하는 비용과 이익의 공정한 분배가 이루어지지 않는다면, 사회적 약자의 생존도 보장하기 어렵다.
국가공동체는 기본적으로 생존을 위한 사회적 단위라고 할 수 있다. 이러한 관점에서 보면, 기후위기대응은 국가가 우선순위에 두고 주도적으로 해결해야 하는 문제에 해당한다. 그런데 국가가 어떠한 문제를 해결하기 위해서는 재정적 뒷받침이 있어야 한다. 더구나 기후위기대응은 사회경제적 구조의 대전환을 요구하며 그에 소요되는 비용은 국가의 재정이나 한 기업의 자금만으로 해결할 수 있는 것이 아니다.
특히 기후위기대응과 같은 환경문제는 이롭거나 해로운 외부효과를 갖는다. 정부가 이러한 외부효과를 이전하거나 내재화하는 정책을 강력하게 지속적으로 추진하여야, 국가재정뿐만 아니라 민간자금이 기후금융으로 모일 수 있다. 이때 국가재정은 민간자금이 기후금융으로 모이는 데 장애가 되는 위험을 분담하고 기후금융을 위한 마중물이 되어야 한다.
기후대응기금이 당면한 문제는 안정적인 자체수입을 확충하는 것이며, 기후대응기금의 확충과 그 용도를 논의하고 조율하여 정하는 것은 우리 국가공동체가 당장 풀어야 할 문제이다. 여기서는 정부가 선도적인 역할을 해야 하지만 다양한 이해관계가 충분히 반영될 수 있어야 한다.
특히 기후대응기금의 효과성과 책임성은 기후위기대응이라는 국가목표를 달성하기 위해 공공부문과 민간부분의 분업적 과제 수행을 어떻게 구조화하느냐와 관련되어 있다.
본 논문에서는 기후대응기금의 효과성과 책임성을 제고하는 방안으로 기금운용계획안 수립․변경 시 탄소중립녹색성장위원회의 참여, 국회 기후위기특별위원회의 상설화 및 역할 확대, 탄소중립녹색성장위원회의 공개성 및 다양성 제고, 미래세대보호위원회의 신설을 제시하였다. 이는 기후위기대응을 위한 통치구조의 민주적 정당성과 절차적 정당성 제고로 기성세대와 미래세대의 기본권을 실효성 있게 보호하여 기본권 기속성을 강화하는 것이 될 수 있다.

다국어 초록 (Multilingual Abstract)

Responding to the climate crisis is a matter of survival not only from the biological perspective but also from the socio-economic perspective. In the climate crisis, survival due to natural disasters such as floods and droughts is not the only problem. Industrial structures that lag behind in the transition to a carbon-neutral society and emit large amounts of greenhouse gases are no longer able to survive. Additionally, if a fair distribution of costs and benefits incurred in the process of transitioning to a carbon-neutral society is not achieved, it is difficult to guarantee the survival of the socially disadvantaged.
Basically, a national community can be said to be the social unit for survival. From this perspective, responding to the climate crisis is a problem that the government must prioritize and take the lead in solving. However, in order for the government to solve any problem, it must have financial support. Moreover, responding to the climate crisis requires a major transformation of the socio-economic structure, and the costs required cannot be resolved solely with national finances or the funds of any one company.
In particular, environmental issues such as responding to the climate crisis have either beneficial or harmful external effects. Only when the government strongly and continuously pursues policies to transfer or internalize these external effects can not only national finances but also private funds be gathered into climate finance. At this time, national finance must serve as a priming agent to share the risks that hinder private funds from gathering into climate finance.
The problem facing the Climate Response Fund is to expand its own stable revenue, and discussing, coordinating and determining the expansion of the Climate Response Fund and its use is a problem that our national community must solve immediately. Here, the government must play a leading role, but diverse interests must be sufficiently reflected.
In particular, the effectiveness and responsibility of the Climate Response Fund are related to how to structure the performance of division of labor tasks between the public and private sectors to achieve the national goal of responding to the climate crisis.
In this paper, as a way to improve the effectiveness and accountability of the Climate Response Fund, the participation of the Carbon Neutral Green Growth Committee in establishing and changing the fund operation plan, the permanent establishment and expansion of the role of the National Assembly Climate Crisis Special Committee, the openness of the Carbon Neutral Green Growth Committee, and Enhancing diversity and establishing a future generation protection committee were proposed. This can effectively protect the basic rights of the existing and future generations by enhancing the democratic and procedural legitimacy of the governance structure to respond to the climate crisis and strengthen the binding of basic rights.
