This study examines the legal frameworks of social housing in major European countries to derive legislative implications for the enactment of a Social Housing Act in South Korea.
While Korea implements various housing support measures—such as public rental housing, housing benefits, and the Housing and Urban Fund—based on statutory grounds, social housing operated by social economy actors for vulnerable groups remains underdeveloped. Unlike private or public rental housing, social housing in Korea is only partially supported by a few local ordinances and lacks a unified, national-level legal framework. In contrast, European countries have developed robust social housing systems over decades through sustained social consensus, particularly emphasizing public interest and sustainability through non-profit-led models.
This study analyzes the social housing laws of nine European countries—the Netherlands, Austria, Denmark, the United Kingdom, France, Sweden, Ireland, Finland, and Germany—focusing on: (1) historical development; (2) housing stock management systems; and (3) legal structures of supply actors. The analysis identifies key success factors in European social housing systems: (1) clearly defined legal concepts and eligibility criteria; (2) fair and transparent allocation procedures; (3) effective coordination between central and local governments; and (4) legal and institutional support to strengthen the capacity of housing providers.
Based on this comparative legal analysis, the study proposes key legislative directions for Korea’s Social Housing Act. The draft law should clearly define the concept of social housing, the types of supply actors, and eligibility criteria. It should also establish objective and transparent allocation standards, clarify the division of roles between central and local governments, and promote cooperative frameworks with both private and social sectors.
Ultimately, by drawing on the European experience, this study seeks to contribute to establishing a legal foundation for social housing in Korea that promotes housing welfare and social integration.
