국유토지 권리보전 방안에 관한 연구 = 일본인 명의 토지를 중심으로

국문 초록 (Abstract)

최근 정부는 재정수입을 적극 확보하고 유지·보존 중심의 국유재산 관리 패러다임을 개발·활용 중심으로 변화시켜 국유재산 관리의 효율화를 추진하고 있다. 특히 국유재산 중 국유지의 비중이 적지 않기 때문에 이에 대한 연구가 상당부분 진행되었다. 이와 같은 국유지 관리방안에 대한 연구에 간과하고 있는 부분이 바로 일본인 명의 토지에 대한 관리방안이다. 일본인 명의 토지는 조사 등의 어려움으로 인하여 사실상 방치되어 왔었다. 따라서 본 연구는 일본인 명의 토지의 효율적인 조사와 관리방안을 제시하였다. 먼저 일본인 명의 토지의 발생원인과 그 관리실태를 고찰하였으며, 조사방안으로 첫째, 대상토지의 확정, 둘째, 관련자료의 발굴, 셋째, 조사인력의 구성 및 유관기관과의 협조체계 구축, 마지막으로 조사 프로세스를 제시하였다. 그리고 정확한 조사를 위해서 전국적인 전수조사를 실시하여야 하며, 전수조사 시 발생할 수 있는 시행착오를 방지하기 위해 대표성 있는 지역을 선정하여 시범사업의 시행을 제안하였다. 일본인 명의 토지 조사는 일제잔재를 청산한다는 정성적인 효과와 국유재산 발굴을 통한 국가재정 확대라고 하는 정량적 효과가 있다.

다국어 초록 (Multilingual Abstract)

Recently, the government has secured finance and pushed ahead with management efficiency of state-owned property by changing the paradigm from maintenance and conservation to development and utilization. Especially, the rate of state-owned land among state-owned property is so considerable that it had been widely studied. Meanwhile, the management about the land of Japanese name has been ignored. It has been neglected due to difficulty of the survey. For this reason, the purpose of this study is to suggest the efficient survey and management method of the land. At first, both the cause of occurrence and the real condition about the land were reviewed. Survey was reviewed through determination of object land, investigation of relevant literature, composition of human resources, construction of cooperation system among related organizations, and suggestion of survey process. In addition, the national complete enumeration should be implemented for improving accuracy; moreover, after selecting a representative region, a pilot projet is suggested to prevent and minimize errors which can occur during the national complete enumeration. the land survey causes both qualitative effects which is clearing up vestiges of Japanese imperialism and political effects which is securing national finance.
