국문 초록 (Abstract)

본 연구는 아동 건강권 보장을 위한 지방자치단체 조례를 분석하여 지 역 단위의 법적‧제도적 대응 수준을 평가하고 정책적 함의를 도출하는 곳인데 목적이 있다. 분석방법으로는 자치법규정보시스템에서 수집한 아 동 건강권 관련 조례 38개를 대상으로 규범성과 실효성 체계를 중심으로 분석틀을 구성하고 이를 비교 분석하였다. 주요 결과는 다음과 같다. 첫 째, 다수의 조례는 일정 수준의 규범성을 확보하고 있었으며, 정신건강, 금연‧절주, 영양 관리 등 아동의 전인적 건강권에 대한 지역사회의 관심 이 반영되고 있었다. 둘째, 전달체계 조항은 주로 강행규정으로 구성되어 실효성 기반이 마련되어 있었다. 셋째, 재정 책임, 전문 인력 구성, 벌칙 조항 등 핵심 실효성 요소는 미흡하거나 임의규정에 그쳤으며, 조례 간 명칭‧용어‧대상 규정의 일관성 부족과 디지털 과의존, 성 건강 등 최근 이슈의 반영 한계도 드러났다. 연구결과를 기반으로, 아동 건강권의 법적 지위 명확화, 강행규정 확대를 통한 실행력 강화, 지역 맞춤형 정책 수립 을 위한 근거 기반 행정, 조례 실행 역량 강화를 위한 교육 및 지원 체 계 구축 등 정책 과제를 제안하였다.

This study examines how local governments address children’s right to health through their ordinances and considers implications for policy. A total of 38 ordinances was collected from the Local Ordinances Information System and analyzed using a framework that considered normative validity and practical effectiveness. The analysis showed that many ordinances reflected local concern for children’s holistic health, including mental health, smoking and alcohol prevention, and nutrition, and provided a basic normative foundation. Provisions on service delivery were generally mandatory, but key elements for implementation—such as fiscal responsibility, staffing, and enforcement—were often weak or optional. The study also found inconsistencies in ordinance titles, terminology, and target groups, and limited attention to emerging issues like digital dependency and sexual health. These findings point to the need to clarify the legal status of children’s right to health, expand mandatory provisions to strengthen enforceability, improve evidence-based governance for local health policy, and support local governments in building capacity for implementation.
