유럽 지역의 '기업과 인권' 규범 형성에 대한 연구: 중층성에 기반한 효율적 혼합을 중심으로 = The Formation of Regional Norms for 'Business and Human Rights' in Europe: Focusing on Smart Mix Based on Multiple-Level Dynamics

This research aims to analyze the characteristics of the regional norms of Business and Human Rights(BHR) that are being formed and deepened in Europe. To this end, we first examine the background and process of how international norms related to BHR were born in international society. And based on this, the formation of BHR norms in Europe is analyzed focusing on two aspects: multiple-level dynamics at the international, regional, and national levels and the smart mix of voluntary soft law and mandatory hard law. Through this, it is intended to contribute to an academic understanding of the differentiated dynamics of norm formation in the European region and an in-depth understanding of the recent EU's corporate sustainability due diligence.

국문 초록 (Abstract)

본 연구는 오늘날 유럽 지역에서 형성 및 심화되어가고 있는 ‘기업과 인권’ 역내 규범 형성의 특징을 분석하는 데 주목적이 있다. 이를 위해서 우선 ‘기업과 인권’ 관련 국제 규범이 어떻게 태동하게 되었는지 그 배경 및 과정을 살펴보고, 이 과정에서 규범의 성격과 관련해 중요한 원칙으로 자리 잡은 효율적 혼합에 대한 논의를 소개한다. 그리고 이를 바탕으로 유럽 지역의 '기업과 인권' 규범의 형성의 특징을 국제, 지역, 국가 층위로 구성된 중층성과 연성규범과 경성규범 사이의 효율적 혼합이라는 두 측면을 중심으로 분석한다. 이를 통해서 유럽 지역 ‘기업과 인권’ 규범 형성의 차별화된 동학에 대한 학술적 이해와 최근 유럽연합에 의해 추진되고 있는 기업 지속가능성 주의의무에 대한 심도 있는 이해에 기여하고자 한다.
