공공갈등의 원인과 이해관계 분석 : 문화재관람료 징수 갈등 사례를 중심으로 = An Analysis of Interests and Causes of Conflict: Focusing on the Case of Conflict caused by Viewing Fee for Cultural Properties

국문 초록 (Abstract)

본 연구는 국립공원입장료 폐지 이후 주요 국립공원지역에서 발생하고 있는 문화재관람료 징수를 둘러싼 정부, 조계종, 시민단체간 갈등 사례에 대하여 주요 이해관계자를 대상으로 한 인터뷰를 토대로 갈등의 발생 및 전개과정, 이해관계자간 갈등의 주요 쟁점 및 갈등 원인분석을 통해 갈등의 해결과 유사 갈등사례의 예방을 위한 시사점 도출을 목적으로 한다. 문화재관람료는 국립공원입장료와의 합동징수구조 및 징수관련 법규정의 포괄성으로 인해 갈등의 잠복 상태에 있다가, 국립공원 입장료 폐지 이후 사찰과 국민간 갈등이 표면화되었고, 사회적 이슈로 발전하자 정부의 개입과 함께 정부, 시민단체, 조계종간 갈등으로 확대되었다. 주요 이해관계자간 제도개선협의회를 통해 주요 쟁점별로 합의형성을 시도하였지만, 현재 정부와 조계종간 입장차이로 인해 갈등이 정체되고 있다. 갈등주기분석과 갈등지도를 통한 주요 이해관계, 쟁점과 이를 통한 원인 분석을 통해 문화재관람료 징수 갈등의 구조적 원인으로서 합동징수구조로 인한 문화재관람료 제도 자체에 대한 낮은 인식과 사전홍보체계의 미흡, 본질적 원인으로서 문화재보호법의 문화재관람료 징수 관련 규정의 모호함, 환경적 원인으로서 배제된 이해관계자와의 형평성 훼손임을 알 수 있었다. 이해관계자간 갈등의 쟁점과 원인 분석을 통해 국립공원제도와 연계한 이해관계자간 갈등구조 인식의 공유, 적극적 커뮤니케이션을 활용한 홍보의 통합적 접근, 법적 근거의 구체화와 명확화, 갈등의 범위와 성격 재정립, 이해관계자간 신뢰구축, 단계적 접근방법 도입이 갈등 해소와 향후 유사 갈등 예방을 위한 주요 시사점으로 제시되었다.

다국어 초록 (Multilingual Abstract)

This study is to draw implications for resolving the conflict and preventing similar conflicts through analyses of conflict occurrence, issues in dispute among stakeholders, and its causes based on interviews with relevant stakeholders including government and civic interest group involved in the conflict on collection of viewing fees for cultural properties in national park area. It has been in latent phase due to the joint collection with an entrance fee for national park and the comprehensiveness of rule. After the abolition of the entrance fee in 2007, it has occurred as a conflict between the buddhism and citizens, and expanded to a conflict among government, civic interest group, and the buddhism with the involvement of government to solve such a social issue. Meanwhile, there have been efforts to resolve the conflict through activities in council among the stakeholders, but it is still unresolved due to the difference between primary interests. TIlls study reveals primary causes of the conflict through analyses interests, issues in dispute among stakeholders, and its causes based on conflict life-cycle analysis and conflict mapping: in structural aspect, low recognition of viewing fees for cultural properties due to the joint collection; in essential aspect, ambiguous rule regarding the collection of viewing fees in cultural properties prevention act; and, in environmental aspect, demage on equity with excluded parties. Through the analyses of issues in dispute and causes, it reports the importance of share of recognition toward conflict structure among stakeholders, comprehensive approach to public relations, clear expression of the rule, triangulation of scope of conflict, building mutual trust, and incremental approach to the resolution for resolving the conflict and preventing analogic conflicts.
