    본 연구는 ‘뉴스페이스(New Space)’ 시대의 도래로 가속화된 민간 주도의 우주자원 개발 활동을 법리적으로 검토하고, 특히 미국, 룩셈부르크, 일본 등 주요국이 도입한 우주자원 사적소유권 인정 법령의 국제법적 정합성을 분석하는 데 목적이 있다.
    현재 우주자원의 법적 지위를 둘러싼 논쟁은 1967년 우주조약(OST)의 ‘전유금지원칙’과 1979년 달협정의 ‘인류공동유산원칙’ 사이의 해석적 간극에서 기인한다. 본 연구는 재산권의 철학적 기초인 로크(John Locke)의 노동이론과 로마법상의 점유와 소유의 구분, 현대 소유권 이론 등을 통해 우주자원 소유권의 정당화 논리를 고찰하였다. 분석 결과, 우주조약 제2조가 금지하는 ‘전유’는천체라는 공간적 영역에 대한 국가의 주권적 영유권을 의미하며, 추출된 자원에 대한 사적소유권까지 명시적으로 금지하는 것으로 해석하기는 어렵다는 결론을 도출하였다. 또한 우주조약 제6조의국가책임원칙에 따라 사인의 우주활동이 국가에 기속된다는 점을 고려할 때, 국내법을 통한 우주자원의 사적소유권 부여가 국제법의 직접적 위반으로 직결된다고 보기도 어렵다.
    그러나 개별 국가의 일방적 입법은 국제우주법 질서의 파편화를 초래하고 자본과 기술력을 선점한 특정 국가나 기업에 의한 자원독점이라는 구조적 불평등을 심화시킬 우려가 있다. 이에 본 연구는 이러한 규범적 공백을 해소하고 우주자원의 지속가능한 이용을 보장하기 위해 조약법에 관한 비엔나 협약(VCLT)상의 ‘후속 합의’ 구조를 활용한 ‘우주 당사국총회(Space COP)’ 모델을 실천적대안으로 제시하였다. 본 연구는 우주자원 소유권 논의가 단순히 허용 여부를 묻는 차원을 넘어 인류 공동의 이익과 상업적 혁신이 조화를 이룰 수 있는 국제적관리체계 내에서의 정당성 확보로 나아가야 함을 강조한다.

    This study aims to legalistically examine space resource development activitiesaccelerated by the advent of the ‘New Space’ era, and analyze the international legalconsistency of domestic legislations in countries such as the United States, Luxembourg,and Japan-that recognize private property rights over space resources.
    The debate surrounding the legal status of space resources stems from interpretive gapsbetween the ‘Non-Appropriation Principle’ of the 1967 Outer Space Treaty (OST) and the‘Common Heritage of Mankind’ Principle of the 1979 Moon Agreement. This researchexamines the justification of space resource ownership through John Locke’s labor theoryand the distinction between possession and ownership in modern legal concepts. Theanalysis concludes that the ‘appropriation’ prohibited by Article II of the OST refers tosovereign claims over celestial bodies spatial domains, making it difficult to interpret as anexplicit ban on private ownership of extracted resources. Furthermore, considering that thespace activities of private entities are attributed to the state under the principle of stateresponsibility in Article VI of the OST, it is difficult to conclude that granting ownershipthrough domestic legislation directly leads to a violation of international law.
    However, unilateral legislation risks fragmenting the international space law order andexacerbating structural inequalities. To address these regulatory gaps, this study proposesthe ‘Space Conference of the Parties (Space COP)’ model, utilizing ‘subsequentagreements’ under the Vienna Convention on the Law of Treaties(VCLT), as a practicalalternative. This study emphasizes that the discourse on space resource ownership musttransition toward securing legitimacy within an international management system where thecommon interests of humankind and commercial innovation can coexist in harmony.
