이주배경 인력 지원 조례에 관한 연구- 경상북도 이주배경 인력 지원 조례 제정안 제안을 중심으로 - = A Study on the Ordinance on Support for Workforce with Migration Backgrounds- Focusing on the Proposed Ordinance on Support for Workforce with Migration Backgrounds in Gyeongsangbuk-do -

국문 초록 (Abstract)

본 연구는 인구감소지역의 지속가능성 확보를 위한 법제적 대응 방안으로서 이주배경 인력 지원관련 조례의 현황을 살피고, 이주배경 인력 대상의 조례 제정 필요성과 입법 방향을 제안하는 데 목적이 있다. 이를 위해 본 연구는 인구감소 대응 및 이주노동 관련 중앙·지방정부의 정책문건, 관련통계, 법령 및 조례 등을 검토하였다. 구체적으로, 가장 많은 인구감소(관심)지역을 보유한 경상북도를 대상으로 이주민 관련 조례와 인구정책 관련 조례의 현황을 분석하고, 이민정책과 인구정책영역 간의 구조적 한계와 규범적 공백을 검토하였다.
분석 결과, 현행 조례는 결혼이주민과 다문화가족 중심으로 설계되어 외국인근로자, 유학생, 재외동포 등 다양한 이주배경 인력을 포괄하지 못하는 한계를 보였다. 또한 이민정책과 인구정책이상호 연계되지 못하고 분절된 정책체계로 운영됨에 따라, 이주배경 인력의 유입이 지역의 정주인구확대 및 경제적 성과로 이어지기 어려운 구조적 문제가 확인되었다. 아울러 이주배경 인력의 권리보장과 사회통합을 위한 제도적 기반이 미흡하여 장기적인 정주 기반 형성에 제약이 존재하는 것으로 나타났다.
이에 본 연구는 이주배경 인력의 유입, 초기정착, 취업, 정주 및 사회통합을 포괄하는 ‘(가칭) 이주배경 인력 지원 조례’ 제정안을 제시하였다. 제안된 조례안은 목적조항, 정의규정, 기본원칙, 종합계획 및 시행계획, 정책협의회, 지원센터, 체류자격별 맞춤형 지원, 인권보호 및 권리보장 등의내용을 포함하며, 기존 개별조례를 통합하는 성격과 정책집행을 담보하는 성격을 결합하여 설계되었다.
본 연구는 이민정책과 인구정책을 통합적으로 접근하여 지방자치단체 차원의 이주법제 재구성가능성을 제시함으로써 이주민 유입에 따른 복지 서비스 지원과 체계적인 이주민 인적자원개발을위한 법제도를 분석한 학문적 의의를 가지며, 인구감소지역의 이민정책 설계와 입법 실무, 지방자치단체 이민정책 수행평가 시 고려사항에 대한 실천적 시사점을 제공한다.

This study aims to examine the current status of ordinances related to supporting migrantworkers as a legislative response to secure the sustainability of regions experiencingpopulation decline, and to propose the necessity of enacting ordinances specificallytargeting migrant workers as well as legislative directions. To this end, usingGyeongsangbuk-do-which possesses the largest number of regions of population decline(or concern)-as a case study, the current status of ordinances related to migrants andpopulation policy was analyzed, and structural limitations and normative gaps between thedomains of immigration and population policy were examined.
The analysis revealed that current ordinances are designed primarily around marriagemigrants and multicultural families, exhibiting limitations in that they fail to encompassdiverse migrant workers, such as foreign workers, international students, and overseasKoreans. Furthermore, a structural problem was identified where the influx of migrantworkers fails to lead to an expansion of the local resident population or economic outcomes,as immigration and population policies operate as fragmented policy systems withoutmutual linkage. Additionally, it was found that the lack of an institutional foundation forguaranteeing the rights and social integration of migrant workers poses constraints on theformation of a long-term settlement base. Accordingly, this study presents a draft of the‘(tentative) Ordinance on Support for Workforce with Migration Background,’ whichencompasses the influx, initial settlement, employment, permanent residence, and socialintegration of workers with migration backgrounds. The proposed ordinance includesprovisions for purpose clauses, definitions, basic principles, comprehensive andimplementation plans, policy councils, support centers, customized support based onresidency status, and the protection of human rights and guarantees of rights. It is designedto combine the nature of integrating existing individual ordinances with the nature ofensuring policy implementation.
This study holds academic significance in that it analyzes the legal framework forsupporting welfare services following migrant influx and for the systematic development ofmigrant human resources by presenting the possibility of reconstructing migrationlegislation at the local government level through an integrated approach to immigration andpopulation policies. Furthermore, it provides practical implications for the design andlegislative practice of immigration policies in regions experiencing population decline, as wellas considerations for evaluating the performance of local government immigration policies.
