The aim of this study is to analyze the relation of Enterprise Law‘s Labor Management Discretion(LMD) and labor mobility under Kim Jong-un regime in North Korea. LMD is the guaranted authority which can be exercised autonomously by state enterprise manager. One of its two aims is to vitalize production by improving labor productivity in enterprises. Howerver, the vitalization of production entails labor mobility. The other is to suppress the labor mobility and secure labor immobility in enterprises. Labor immobility is essential to allocate the working population to the economic sectors according to state economic planning and labor planning(PEPLP). PEPLP is threatened by the labor mobility.
In this respect LMD is stipulated by the conflicting double aims. The aim of bringing about economic effects by stimulating labor productivity is constrained by the aim of preventing the social disturbances and securing regime's political stability by suppressing the labor mobility which is not organized and not supervised directly by the state. As a result the use of LMD is selectively approved or nullified by the state, which means the regime seeks its survival by means of the instrumental use of LMD and the centralized labor management system.
