국문 초록 (Abstract)

본 연구는 그동안 공익개념 연구가 다양한 시각에서 논의되고 있음에도 불구하고 규범적 측면의 연구수준에 머물러있다는 점에 주목하고, 실제적 차원에서 우리나라 공익관련 법률내용을 중심으로 공익개념을 분석하였다. 연구결과에 따르면, 첫째, 시기별로 다양한 차원에서 공익개념이 나타나고 있다. 즉, 1950년대 이후 불특정한 다수이익, 특정 대상집단 이익보호라는 개념이 전반적으로 출현하고 있으며, 1990년대에는 재산권 제약, 사회적 약자보호라는 공익개념이 발견되고 있다. 분야별 공익개념 구성요소도 상대적 출현빈도 차이가 나타난다. 둘째, 공익개념 요소는 공동체 다수이익, 이익보장, 재산권 제약, 보편적 가치, 공공재 생산 및 공급, 공개성 등의 순으로 나타나고 있으며, 법률에 나타난 공익 세부내용은 불특정 다수이익, 정책 및 제도관련 특정 대상집단 이익보호 등이 다수로 발견된다. 분야별 공익개념 성격으로 노동은 절차 공정성으로서의 공익, 환경 · 금융 · 산림 · 행정관리는 포괄적 일반이익으로서의 공익, 건설과 농림수산은 행위제한 근거로서의 공익, 정보통신과 교통은 지원과 보호 대상으로서의 공익, 경제와 산업은 일반이익과 특수이익이 병존하는 공익이다. 셋째, 공익은 개념의 다차원성, 개념의 추상성, 집단성, 개인적 귀속가능성의 속성을 지닌다. 공익은 사익을 초월한 것 같지만 궁극적으로 사익보호를 전제로 하고 있다. 사익과 무관한 공익이 따로 존재할 수 없으며, 이 점은 공익개념의 적용이나 실천과정에서 재정의 되는 공익과정론을 시사해 준다.

This study examines the features and changes in the concept of public interest. The present articles are intended to serve as a theoretical study on the concept of public interest. Thus, this paper is conducted in a content analysis approach from 1950 to 2008 through a law related to public interest in Korea. To do that, the results are as follows. First, a great variety on the concept of public interest published for many years. That is, public interest indicates profit security, a large number profit, control of property, production and delivery of public goods, opening to proceedings. Second, a concept of public interest possesses the features of multi dimensional world and an abstraction, and in this way, results of this study suggest a processional theory of public interest in practical application of public interest. Despite, this paper is a basic study in the level of exploratory research. We hope this article is able to provide an impetus for understanding public interest.
