지적재산권 분야에서 public domain이란 권리자에 의한 독점이 인정되지 않고 사회구성원 모두가 이용 가능한 지적 재산을 일컫는 개념이다. 종전까지 public domain이라는 개념은 법에 의하여 보호받지 못하는 지적재산을 일컫는 소극적 의미로만 사용되었다. 법에 의하여 보호받는 지적재산은 private domain으로, 보호받지 못하는 지적재산은 public domain으로 구분하여 왔다. 과거 지적재산권이 보호되지 않던 시대에 있어서는 공개된 모든 정보는 public domain의 영역에 있었다. 그러나 지적재산권이라는 개념이 생겨나고 개인의 저술이나 발명이 권리로서 보호되기 시작하자 비로소 private domain의 영역이 생겨나기 시작하였다. 이렇게 생겨난 private domain은 지적재산권의 역사와 함께 그 영역을 확장하여 왔는데, 특히 최근 20년간 과거에 public domain의 영역에 속해 있던 지적재산들, 예컨대 비즈니스모델, 데이터베이스 등이 급격히 private domain 영역으로 흡수되는 현상이 목격되고 있다. 지적재산권을 전문으로 하는 대부분의 학자나 실무가들은 이와 같은 지적재산권의 보호범위 확대가 사회의 발전이라고 생각하고 있다. 저작자나 발명가와 같은 지적재산권자에게 새로운 지적 창조를 자극하기 위한 충분한 보상이 제공되어야 하고 그것이 종국적으로는 우리 사회의 발전을 위하는 것이라는 논리의 연장선상에 있는 것이다. 그러나 과연 public domain의 영역을 점점 축소해 나가는 것이 우리 사회의 발전이라고 단언할 수 있는 것일까? 이 글에서는 pubic domain의 개념을 재고해 보고, 과연 그 영역이 “가치 없는 지적 폐기물을 버리는 가상의 폐기물 처리장인가 아니면모든 새로운 창조를 위한 샘물인가”에 관하여 살펴보고자 한다. 아울러 소위 제2차 인클로저 운동으로 비유되는 디지

In the intellectual property law, the public domain is a concept indicating the intellectual property which is not owned by a right holder in a monopolistic way and subject to a free public use. In the past, the public domain is a negative concept that something is not protectable or protected under the law. There has been a distinction between the public domain which is not protected under the intellectual property law and the private domain which is protected under the law. In those days when the intellectual property was not protected, all the information published was in the public domain. The private domain was recognized only after the concept of intellectual property was formed and a person’s writing and invention started to be protected as a kind of new right. The private domain has been expanded ever since it was recognized. Especially in this past 20 years the intellectual properties which were in the public domain such as a data base and a business model have been radically absorbed into the private domain. Many o f scholars and practitioners specialized in the intellectual property law believe that the expansion of protected intellectual property is a symbol o f the advanced society. It is on the same line o f logics that a full compensation should be provided to a writer or creator to stimulate a new writing or invention, which brings a benefit to all the members o f our society. However, is it really true that the continuing shrink of the public domain will produce more social benefits? In this article, I like to reconsider the concept o f the public domain whether it is a “a virtual wasteland o f undeserving detritus or the font of all new creation.” I will also review the possible threat to the public domain by the recent protection of the digital copyright, which could be called as “ the Second Enclosure Movement.”
