민간조사제도의 규제방안과 소관부처에 관한 고찰 = Study on Regulation Plan and Competent Authorities on Korean Private Investigation System

다국어 초록 (Multilingual Abstract)

In the middle age in Europe, private police began before establishing public police. This tradition continued and expanded to private investigation field. In japan, private investigation industry started running from 1970s, and it's boundary expanded ordinary people's life such as searching missing child, chasing criminal, supervising worker, surveillance over industrial spy, so on.
Korean society also have long tradition of private investigation. But, public social security agencies such as National Police Agency, Public Prosecutor's Office, Customs Service, and National Intelligence Service, didn't agree on legitimacy of private investigation industry. To the contrary, private security industry acquired legitimacy by making Private Security Law.
Legislative bill on Private Investigation Law were presented by two political parties, the Grand National Party and the Democratic Party. These two political groups have same needs on legitimacy of private investigation and presented similar bill on it. Most contents of their bills on private investigation industry reflect needs and will of field workers. But, some contents have contrary position and represent public sector's interest such as qualification of license, examination, etc.
In order to promoting private investigation industry in korean society, entrance barrier will be broken, and open doors to workers on private sector. And, public agencies make positive minds to private investigation industry. The harmony with public security and private investigation will reduce the crime occurrence rate, and prevent violent crime, crime against property, bribery, kidnapping so on.
Private investigation is service industry. So, the development of private industry in Korea will be best export service product to China and south Asian Countries such as Malaysia, Indonesia, Vietnam, Cambodia, Lao, Philippines. Mostly, bringing-up qualified agents and agencies is important factors on success of korean private investigation industry. Public sector have to support private investigation in the field of law.

국문 초록 (Abstract)

현대경찰의 시초라 할 수 있는 유럽의 경찰시스템은 중세시대의 민간경비에 그 뿌리를 두고 있다. 이러한 전통은 그대로 경찰의 발전과 민간경비의 여러 세부관련 분야의 발전에 많은 기여를 하였으며, 특히 민간조사제도의 발전에 상당한 영향을 미쳤다. 일본도 유럽과 미국의 민간조사제도가 가진 장점과 긍정적 측면을 받아들여 1970년대부터 본격적으로 산업의 한 분야로 성장을 시켰으며, 경찰의 보조자적 역할을 수행하도록 하였다. 특히, 가출인 찾기나 미아찾기, 산업스파이 색출, 지명수배자의 추적 등에서 많은 활동을 벌이고 있는 실정이다.
대한민국도 역시 오래 된 민간경비의 역사를 가지고 있다. 하지만 일본의 식민지배와 한국전쟁, 군부독재 등의 험난한 역사를 거치면서 그 전통이 이어지지 못하였으며, 결과적으로 유럽이나 미국과 같은 민간사법영역의 발전이 이뤄지지 못하였다. 경찰청이나 검찰청, 세관, 국가정보원, 출입국관리국 등의 형사사법기관들은 외적으로는 민간조사의 제도화에 대해 찬성하고 있지만 내부적으로는 반대하는 입장을 취하고 있다. 민간조사는 민간경비의 법제화와 마찬가지로 현재의 상황에서 반드시 필요한 제도라는 점을 인식해야 한다.
현재 한나라당과 민주당에서 각각 서로 다른 민간조사 관련 입법안을 내놓고 있지만 내용적인 부분에서는 큰 차이를 보이지 않고 있다. 여당과 야당에서 동시에 민간조사업과 관련한 법제적 움직임을 보인다는 것은 실질적으로 이 영역이 우리 사회에 필요하다는 의미로 해석할수 있을 것이다. 현장에서 불법이 아닌 불법적인 일을 하고 있는 민간조사분야 종사자들은 시급이 국회의 통과를 기대하고 있으며, 제대로된 민간조사 시스템 하에서 일을 하기를 원하고 있다.
대한민국 사회에서 민간조사제도가 제대로 뿌리를 내리고 활성화되기 위해서는 법률시장의 협소함을 과감하게 타파하고 합법적인 테두리 안에서 일을 할 수 있도록 하는 제도적 장치의 마련이 선행되어야만 한다. 또한 사법권이나 공적 조사권을 가지고 있는 사법기관들 역시도 민간조사 영역을 하나의 파트너적 영역으로 생각하여 긍정적으로 바라보는 시선의 전환을 이뤄야만 한다. 공적 수사영역과 사적인 민간조사영역이 상호간에 조화를 이루면 현재 심각하게 나타나고 있는 사기나 횡령, 산업스파이, 지적재산권 침해 등의 범죄문제를 효과적으로 해결 하는데 큰 기여를 할 것이다.
민간조사업은 중요한 고부가가치 산업의 일종이다. 흥신소나 심부름센터와 같은 식의 일은 극히 일부분에 불과하며 공공기관의 조사업무대행도 우수한 인력과 자원을 가지고 수행 가능하다는 점에서 이를 적극적으로 육성해야 한다. 아울러 신속한 산업의 육성을 통해 민간조사업을 중국이나 인도네시아 베트남 등의 중국과 동남아시아지역으로의 수출을 모색해야 하는 시급한 숙제를 가지고 있다. 대한민국 민간조사업의 발전을 통해서 법률서비스의 수준향상은 물론 관련한 여러 가지 개인적 분쟁과 범죄예방, 범죄의 확정, 사실확인 등이 명확하게 이뤄질수 있다. 본 논문은 이러한 내용을 주제로 하였으며 다양한 스펙트럼 안에서 세밀한 사고를 해보고자 하는데 그 목적이 있다.
