예술인 고용보험제도 실행을 위한 기초연구

국문 초록 (Abstract)

본 논문은 2011년 「예술인 복지법」 제정을 기점으로 예술인을 위한 사회보장제도 구축 단계에서 논의 중인 고용보험제도 실행과 정착을 위한 기초연구로서 한국사회에서 왜 고용보험제도 정착이 어려운지, 이를 해결하기 위한 쟁점은 무엇인지를 살펴보며, 해외 유사사례와의 비교 연구를 통해 가능한 지점을 제시하고자 한다.
「예술인 복지법」 제정 목적은 예술인의 고용 안정성과 사회안전망 구축 등 예술인 사회보장제도 확립 및 사회보험 보장에 있었으나, 관계법령 및 정부부처 간의 합의점을 찾지 못하여 관련 조항이 대부분 삭제되었다. 그 이후부터 문화체육관광부와 고용노동부는 예술인의 고용보험 적용을 위하여 현행 고용보험제도를 개선하기 위한 절차를 진행하고 있다. 구체적으로는 예술인의 직업적 특수성을 고려하여 「고용보험법」상의 지위를 설정하고 이에 따른 적용 방안을 마련하는 등 관련 법령 개정을 추진하기로 협의하였으며, 문화체육관광부는 「예술인 복지법」에서의 고용보험 조항을 신설하기 위한 준비를 하고 있다.
수년간의 준비에도 불구하고 제도의 구축이 더디게 이루어지고 있는 이유와 쟁점을 정리하면, 첫째 관련 부처 및 관계법령과의 충돌 문제에 대해 어느 범위까지 합의점을 도출할 수 있는지의 문제가 있다. 둘째 재원조성 및 예산상의 형평성 문제에 대하여 예술인 사회보장을 위한 별도의 예산 확보 또는 다른 대안이 필요하다는 점이다. 셋째 예술인의 근로자 의제를 통한 고용보험 가입의 가능성과 정당성의 문제이다.
해외에서 예술인의 고용보험제도가 실행되고 있는 국가는 주로 유럽 국가들이며, 이번 연구에서는 프랑스, 독일, 영국, 벨기에의 사례를 통해 안정적으로 운영되고 있는 해외의 제도를 조사 분석하였다. 예술인 정책을 수립 및 실시하는 과정에서 야기되는 쟁점에도 불구하고, 이 국가들에서는 어떠한 배경을 통해 정부 차원에서의 예술인 고용보장을 실현할 수 있었는지 분석하였다. 그리고 이를 통해 우리나라에 적용 가능한 범위를 찾아 제시함으로써 보다 발전적인 제도 구축 방안을 모색하였다.
예술인 고용보험제도 실행의 문제는 무엇보다도 예술인의 사회보장에 대한 범국민적 동의를 얻어내기 위해 국가 차원에서의 담론을 지속적으로 제시하는 것이 중요하다. 우리나라가 예술인 복지제도를 국가적 차원에서 발전시켜 가고 있는 현시점에서 예술인의 사회보장제도에 대한 선진적 체계를 구축하는 데에 본 연구가 보탬이 되기를 기대한다.

다국어 초록 (Multilingual Abstract)

The thesis here, a fundamental research for implementation and settlement of employment insurance system which has been discussed as a part of social security system for artists that has started from the enactment of 「Artists Welfare Law」 in 2011, suggests a possible point by examining why the settlement of employment insurance is difficult in Korean society and which issues can be brought to solve the problem under the comparative study with overseas similar cases.
The initial purpose of legislation of 「Artists Welfare Law」was to establish a social security system for artists such as strengthening the social safety net and employment stability, and related articles are erased since the middle ground could not be found between related statute and the government ministry. Since then, the Ministry of Culture, Sports, and Tourism and the Ministry of Employment and Labor have made progress of improving current employment insurance system in order to apply artists’ employment insurance. To put it concretely, they agreed on revising related laws to make special status on 「Employment Insurance Act」upon consideration of artists’ professional special characteristics and application plan, while the Ministry of Culture, Sports, and Tourism are preparing for inserting the article of employment insurance in 「Artists Welfare Law」.
In spite of several years of preparations, the system’s establishment have been progressing slowly because of those points here. First, to what extent the middle ground can be found in terms of the conflict between related statute and the government ministries; Second, an alternative remedy or separate budget plan for artists’ social security is required as there is an issue of fairness on budget and development of financial resources; Third, the possibility of artists’ join of employment insurance through worker’s agenda and its legitimacy are problems too.
The countries which enforce artists’ employment insurance system are mainly in Europe, the study examined and analyzed stabilized foreign systems through cases of France, Germany, the UK, and Belgium. The study analyzed how those countries could enforce artists’ employment guarantee at government level notwithstanding issues brought during the process of establishing and executing policies for artists, and through it, the study seeks advanced system establishment remedy by finding possible applications for Korea.
Above all, a continuous discussion should be suggested at government level in order to get pan-national agreement on implementing artists’ employment insurance system. Hope this study helpful to build an advanced social security system for artists at home, which is currently at the early stage of constructing and developing welfare system for artists.
