아리스토텔레스의 형평(epieikeia): 구체적 타당성을 위한 덕 = What would Aristotle's virtue of equity be like in Korea?

In this article, I aim to specify the content of the virtue of equity, which Aristotle sketches only briefly in Nicomachean Ethics Book 5, Chapter 10, by applying it to Korean judges. I start by explaining what rules are, their characteristics and values ​​(section II), and examine the areas in which judges have the discretion to deviate from legal rules and guidelines in light of the specific circumstances of particular cases (section III). I contrast the virtue of equity with the vice of disregarding legal rules and the vice of worshiping legal rules (section IV), and argue that the virtue of equity is actually compatible with the rule of law which is often considered to be in conflict with it (section V). I further clarify the nature of equity by examining closely related virtues such as judicial wisdom, temperance, perseverance, and courage (section VI). I explain the process in which an inexperienced judge, with the help of experienced judges, develops the relevant character traits and the intellectual ability for independent thinking, through the experience of equitable trials (section VII). Hard cases, I argue, provide judges with the opportunity to exercise the virtue of equality and live an interesting and meaningful life (section VIII). This article demonstrates that Aristotle's virtue ethics is a promising research program that is applicable to contemporary circumstances, and supports moral particularism, the view that the criterion of right action is not codifiable into exceptionless rules.

국문 초록 (Abstract)

이 글은 아리스토텔레스가 <니코마코스 윤리학> 5권 10장에서 소략하게 기술한 형평이라는 덕의 내용을 현재 한국의 상황을 소재로 하여 구체적으로 설명하는 것을 그 목표로 한다. 규칙의 의미와 그 특성 및 가치를 설명한 후(II절), 법을 해석함에 있어 법적 규칙을 적용하는 것을 넘어 개별 사안의 특수성을 감안하여 구체적 타당성을 추구할 것이 기대되는 법관의 재량 영역들을 살핀다(III절). 형평의 덕을 '법규 무시' 및 '법규 맹종'이라는 악덕과 대비하고(IV절), 종종 형평과 상충한다고 여겨지는 법의 지배와 양립 가능함을 보이며(V절), 형평의 덕을 발휘하려면 필요하지만 결여되기 쉬운 사법적 지혜, 절제와 인내, 용기와 같은 관련 덕목들을 살펴봄으로써(VI절), 형평의 내용과 특질을 보다 명확히 한다. 미숙한 판사가 숙련된 판사들의 도움을 받아 여러 번의 형평에 맞는 재판 경험을 통해 성격적 탁월성과 독립적으로 판단하는 지적 능력을 함께 발달시키는 과정을 설명하고, 형평의 덕을 함양하는 현실적 지침으로 ‘규칙 맹종’의 악덕을 피하려 해야 한다고 제안한다(VII절). 기존 법규의 단순한 적용을 넘어야 하는 어려운 사건들이 법관에게 형평의 덕을 발휘하여 삶을 흥미롭고 보람 있게 할 기회가 됨을 보인다(VIII절). 이로써, 아리스토텔레스의 덕 이론이 현대의 다양한 상황에 적용될 수 있어 잠재력이 풍부한 연구프로그램임을 예증하고, 실천적 지혜를 가진 유덕한 사람의 숙고와 옳은 행위의 기준이 예외 없는 보편적 규칙으로 성문화될 수 없다는 특수주의(particularism)을 뒷받침한다.
