In May 2007, the Roh Moo-hyun administration introduced a plan on the Program for advanced Mass communication News-gathering Support System, which is currently pending at the Constitutional Court.
Journalists strongly criticized the plan, arguing that the Minimizing of press rooms restricts the people's right to know and violates the freedom of press. But Prime Minister Han Duck-soo said the project is aimed at upgrading the government's support system for news coverage and meeting what he described as global standards.
The above debates are just based on the same analogies discussed under the public trusteeship model. In this regard, I believe that the on going contention was premature.
The Korean government and Journalists should have assessed the applicability of the public trusteeship model within Korea's Constitutional framework.
Through this study, I tried to analyze the constitutional meaning of the right to know and the freedom of news gathering in Korea and compare them with concepts under the US Constitution. This study is aimed at proposing a standard of judgement for disputes on violating the freedom of news gathering.
