    According to the definition of United Nation, the aging society has more than 14% of 65 years and over. Aging society has reached advanced because of their long lives and the small number of birthrate. Therefore a long time nursing is needed.
    At present, an economic condition, inactivity, disease of the aged becoming on issue in the home as well as the society. The state or family are bound to responsible for the aged. However, the provisions of the civil code apply to first of all the aged who stand in need support.
    The legal principles of support under the Korean Civil Code show some deficiencies. In particular, the support of old parents classified as a secondary support, so that the old parents fall into the vacuum state of legal protection.
    This paper is to raise the problem how to support the aged parents. Therefore, this paper is written the problem on the legal principles of support under Korean Civil Law. To achieve the aim, this paper mainly carried out 1) surveys on the theory of support under the civil law, 2) the relation between the public support and private support based on the private-support-first principle.
