부동산 경·공매 전자 입찰 제도에 관한 연구 = A Study on the Real Estate Auction and Public Sale Electronic Bid System

Real Estate is a base of human life and the importance of the real estate is increasing.
People become highly interested in the real estate sale as transactions by public auction are increasing.
Many people who would like to buy the house and invest on the real estate show their interest becasue the number of real estate for public auction is growing as insolvent obligations have been increasing since IMF crisis and revison of the constitution made the process simpler.
Korea Asset Management Corporation carries out the public auction done by the process for delinquency in payment of the national tax and developed Electronic Property Disposition System and provides online bid service through the web site (www.onbid.co.kr). The Office of Supply constructed 'Nara Jang Ter(www.g2b.go.kr) which is the Electronic Bid System since 2rd November 2007 to provide Electronic Supply Service and Electronic Bid Service.
These Electronic Bid Systems are making new paradigm so other public institutions, local levels of government, and banking organs are willing to accept those.
More transferring to new systmes are taken place by gorvernment's computerization policy in the 21st century that include revolutions on telecommunication, digital society, etc.
However, more transactions for public auctions on the real estate are done through offline until now which cuases the lack of transparency, fairness, and effectivenrss. And there is not enogh preperation for system and process while many participants are getting hard time due to problems on system, process, time taken, and social cost increasing.
This stidy deals with Onbid system from Korea Asset Management Corporation and Nara jang ter from the Office of Supply, especially on systems and processes compared with the process for public auction on the real estate so that to take a look into the problems on Electronic Bid systems and the expected improvements. This study also suggests overall system operation that includes developement of Electronic Bid systems, construction of the systems, and the connection with Electronic Property Disposition System, security systems, Customer supporting centers, etc.

국문 초록 (Abstract)

부동산은 인간생활의 기본 토대를 이루고 있으며 사회가 발전함에 따라 부동산에 대한 중요성도 높아지고 있다. 부동산을 매수하는 여러 가지 방법 중에 경·공매를 통한 부동산 거래가 증가함으로써 일반사람들의 높은 관심을 이끌어내고 있다. 이러한 배경으로는 IMF체제를 거치면서 부실채권의 증가로 인한 부동산 경·공매 물건의 증가와 경·공매의 법개편으로 인한 절차의 간소화 되면서 저렴하게 내집마련의 꿈을 이루려는 사람들과 투자의 목적으로 이용하려는 사람들의 등장으로 부동산 경·공매의 대중화가 이루어졌다.
국세체납처분절차에 의해서 진행되어지는 공매는 한국자산관리공사로 하여금 공매 대행을 하게 하여 전자자산처분시스템을 개발하였고 2002년 10월부터 ‘온비드(http://www.onbid.co.kr)’를 통하여 전자입찰서비스를 제공하고 있으며 조달청은 2000년 11월3일 정부범용 전자입찰시스템 ‘나라장터(http://www.g2b.go.kr)’를 구축하여 전자조달서비스 및 전자입찰서비스를 제공하고 있다. 이러한 전자입찰제도의 도입은 새로운 패러다임을 만들어가고 있으며 다른 공공기관, 지자체, 기업체, 금융기관 등 그 전자입찰을 도입하려는 움직임의 범위가 점점 넓어지고 있다.
21세기 정보통신혁명, 디지털 사회 등의 정보화 시대를 맞이하여 정부의 정보화혁신을 위한 사법부의 전산화 정책에 의해 많은 부분이 새로운 시스템으로 전환이 이루어 지고 있다. 하지만 아직까지 부동산 경매는 법개정을 통한 경매절차상의 간소화로 인하여 진행방식이 조금 신속해졌지만 기존의 오프라인 방식을 고수하고 있어 입찰업무의 투명성·공정성·효율성이 결여되어 있고 그로인한 입찰참가자들이 절차상의 불편과 입찰참가에 소요되는 시간과 사회적 비용 부담이라는 이중고를 겪고 있지만 아직까지 이러한 문제점을 개선을 하기위한 제도적·구조적인 준비가 되어있지 않은 상태이다.
본 논문에서는 이러한 문제점을 해결하기 위하여 한국자산관리공사의 ‘온비드(http://www.onbid.co.kr)’ 시스템과 조달청의 ‘나라장터(http://www.g2b.go.kr)’ 시스템의 절차와 부동산 경매 절차를 비교 분석하여 부동산 경매에 전자입찰제도 도입에 관하여 점검해보고 그와 더불어 기존의 전자입찰 시스템의 문제점과 법제의 개선사항을 살펴보았고 부동산 경매의 전자입찰제도에 관한 전자입찰 시스템 개발, 시스템 구축 재원, 기존 자산처분시스템과의 연계, 보안시스템, 고개지원센터의 신설, 그 외 사용상의 문제점 등의 전반적인 시스템 구축에 관련된 사항을 제시하였다.
