테러리즘의 개념 분석: 테러리즘대응 논의에의 시사점 = Concepts of Terrorism: Implications for anti-terrorism legislations in South Korea

As the fear over terrorism expands, active debates continue to take place. At the core of these conversations is the concept of terrorism and anti-terrorism legislation. Legislation has failed due to abuses of power given the ambiguity of the concept of terrorism and the controversy over the possibility of human rights violations despite steady attempts to pass anti-terrorism legislation over the past 15 years.
The purpose of this study is to examine the definitions of terrorism and draw implications for anti-terrorism legislation. For this purpose, the study initially introduces three major elements of terrorism: the political purpose, the use of violence, and the targeting of the innocent people. Second, the study establishes four types of definitions of terrorism: ①comprehensive definitions, ② definitions in accordance with international treaties, ③ definitions according to the purpose of terrorism, and ④ definitions according to the impact or effect of terrorism. Finally, the study analyzes the concepts of terrorism as stated in the ten anti-terrorism bills proposed thus far and provides insight into the legislative discussions which have taken place on the subject of terrorism.

국문 초록 (Abstract)

테러리즘에 대한 공포가 확대되면서 테러리즘에 관한 논의가 다시 활발히 이루어지고 있다. 논의의 핵심은 테러리즘의 개념과 테러리즘에 대한 대응 입법이다. 지난 15년간 테러리즘대응 입법시도가 꾸준히 이루어지고 있지만, 테러리즘 관련 개념의 모호성으로 인한 권력남용이나 인권침해 가능성에 대한 논란으로 입법에 실패했기 때문이다.
따라서 이 연구의 목적은 테러리즘의 개념을 분석하여 테러리즘대응 입법 논의에 시사점을 제공하는 것이다. 이를 위해 본 연구에서는 첫째, 테러리즘의 주요 특징인 정치적 목적, 폭력의 수단, 일반시민 대상이라는 3가지 요소를 테러리즘의 구성요소로 설정한다. 둘째, 테러리즘의 개념 정의 방식을 4가지 방식, 즉 ① 포괄적 정의방식, ② 국제조약에 의거한 정의방식, ③ 테러의 목적을 제시하는 방식, ④ 테러로 인한 영향이나 효과를 결부시켜 정의하는 방식으로 구분한다. 마지막으로 이러한 분석틀을 활용하여 그동안 발의된 10개의 테러리즘 대응 법안들이 정의하고 있는 테러리즘 개념을 분석함으로써 테러리즘 대응 입법 논의에 시사점을 제공하고 있다.
