자격․면허증의 취득자 우대․활용법령과 직업규제- 국가기술자격을 중심으로 = Occupational Regulation and Statutes of Preferential Treatment for Certificate or License practitioners - Focusing on National Technical Qualifications

This study aims to examine occupational regulation effect of preferential treatment in statutes for National Technical Qualifications. After classifying the statute into four types, this paper analyzed the effect of statutes on the pass rate by multiple regression analysis. And the regression model added variables such as excess demand and qualification grade to improve the goodness of fit. The result showed two key points. First, excess demand of NTQs had negative correlation effect. This means that the more relative number of applicants for the test than numbers of certificate practitioners the more occupational regulation was increased. Second, 'the authority of jobs', 'special appointment ordinance' vested in NTQs' practitioner in the four type of statutes had significant negative effect on the pass rate. This means that these two types of statutes played role of occupational regulation. Finally, statutes of preferential treatment for certificate or license practitioner in NTQs are playing the function of occupational regulation.

국문 초록 (Abstract)

본 연구는 국가기술자격을 대상으로 취득자 우대․활용법령이 직업규제에 미치는 효과에 대해서 살펴보았다. 우대․활용법령을 특징적 유형에 따라 네 가지로 구분 한 후, 이들 법령이 합격률에 미치는 효과를 다중회귀분석을 활용하여 분석하였다. 아울러 모형적합도 향상을 위하여 자격등급, 초과수요 등의 변수를 추가하였다. 그 결과는 다음과 같았다. 첫째, 자격의 초과수요는 합격률과 부(-)의 관계를 보였다. 이것은 상대적인 응시자의 수가 기존 자격소지자 수보다 많을수록 해당 직업의 진입규제가 높아지는 것을 의미한다. 둘째, 자격의 우대․활용법령의 유형 중 직무권한 부여 및 선임․임용에서 합격률과 유의미한 부(-)의 관계를 보였다. 이것은 4가지 우대․활용법령 가운데 직무권한 부여 와 선임․임용이 실질적인 직업규제의 기능을 수행하고 있음을 의미한다. 따라서 국가기술자격 우대․활용 법령은 직업규제 기능을 가지고 있다.
