代理母契約의 문제점과 유효성 여부 = Ligalty and Problems on Surrogacy Arrangement

Every person feels happy when his/her desire is fulfilled. It is the most natural desires for people to have their own child. But some people fail to have a child because of biological defects or others. In this case, people can adopt other's children. But they cannot fulfill their desire because they think the adopted child is not their own bloodlineage.
The surrogacy arrangement means the the married couple who couldn't have their own child because of woman's infertility enters into a contract with a volunteer woman to bear a child. It is carried out the Artificial Insemination without a sexual intercourse. A husband(prospected father) inseminates his sperm to a surrogate mother with the help of medicine.
Our country has no laws on that. But many scholars have denied the validity of the surrogacy contract according to Art 103 Civil Law which bans a anti-public policy and a anti-social order.
However, except for profit-making surrogacy contract, we accept a voluntary surrogacy contract. The most important thing, I think, that we have to consider 'the best interest of the child' first of all for the baby's future.
