      Our autonomous driving technology reached the global level. But the legislative discussion process and the institutional foundation pertinent to this are not nearly enough compared to technical standard. A cause for an accident of autonomous vehicle comes to be created by errors and mechanical defects of the autonomous driving system, nob by a driver’s operational error. Accordingly, because the accident is deep-seated and because the considerable time is taken until deciding the person responsible for indemnity, the institutional and well-established regulation is needed for protecting an insurance consumer. Hence, the purpose of this study is to arrange an independent legal system related to the whole operation of autonomous vehicle in the aspect of protecting an insurance consumer.
      This study enacts 「special law for the commercialization of autonomous vehicle」 (hereunder called special law) in order to approach with the complementary aspect of current law focusing on the liability method and the safety standard given the occurrence of autonomous-vehicle accident at the advanced(level 3) stage, and aims to brace for the age of commercialization henceforth. Specifically, the objective is to expand the main agent of a liability burden in case of accident through considering the process and characteristic of legislative trends for autonomous driving industry regarding the protection of victim in major countries, and then through comparing it with the system relevant to domestic autonomous driving. In addition, it intends to prescribe institutional safety standard pertinent to autonomous driving as well as an autonomous-vehicle manufacturer, and to propose safety standard in relatively high level through special law. Especially, to establish the legislative foundation of autonomous driving through enacting special law, 6 main types were included as the components of special law.
      This study will contribute to the development in autonomous driving industry through protecting an insurance consumer with the objective of being applied even to the stage of future commercialization as well as to the test run of autonomous vehicle that is under research and development even now.
