지역방송 전파료 책정체계와 배분과정의 쟁점 = Issues on Sharing and Distributing Local Broadcasting's Advertising Income

국문 초록 (Abstract)

이 연구는 지역방송사가 한국방송광고공사를 상대로 제기한 손해배상 청구소송, 구체적으로 '전파료 소송'의 쟁점에 대해 주목하고 지역방송사와 중앙 키 사간의 불합리한 전파료 책정을 분석하고 평가하였다. 법원은, 광고주로부터 수령한 전파료를 중앙사와 지역방송사들에게 어떻게 산정하고 배분할 지에 대한 결정권한 내지의무가 코바코에게 있다고 보기 어렵다면서, 원고의 청구를 기각하였다. 하지만 코바코 독점시장 체제에서 방송광고 요금정책 결정이 코바코의 소임이었던 것을 감안한다면 전파료 책정과 배분의 권한, 의무 뿐만 아니라 지역방송사 간의 협의와 합의에 대한 책임도 코바코에게 있다고 보는 것이 타당하다. 이 연구의 분석대상인 판결이나 방송광고균형발전위원회의 심의 내용에 나타난 바와 같이 지역방송사들과 중앙 키사, 그리고 매체사를 대리하는 미디어렙 간의 분쟁은 매우 오랫동안 불합리한 방식으로 유지되어 왔다. 따라서 3조원에 이르는 방송광고 시장의 규모를 고려할 때 방송광고 요금과 매출배분의 조정은 매우 시급한 과제이며 이를 위한 합리적인 배분기준의 구축과 시행이 필요하다고 하겠다.

다국어 초록 (Multilingual Abstract)

This study examined the meaning of a 'radio wave fee' lawsuit between a local broadcaster and KOBACO(Korea Broadcast Advertising Corporation) and analysed illogical radio wave fee policy. TJB(Taejeon Broadcasting Corporation) claimed that KOBACO is liable for TJB's financial losses by adopting an arbitrary standard to distribute broadcasting advertising income as a monopolistic institution. Seoul Central District Court ruled that KOBACO does not have the responsibility for fixing the distributional proportion of radio wave fee. However, considering KOBACO's duty of decision on policy of broadcasting advertising income under KOBACO monopolistic market system, it seems resonable to acknowledge that KOBACO has the responsibility of not only the distributional proportion of radio wave fee but also the distributional agreement among local broadcasters. The conflict on advertising income among local broadcasters, a key station, and media representatives has been kept for a while. Therefore, it is needed to execute a more appropriate distributional proportion policy of radio wave fee.
