베트남 토지가격 산정제도에 관한 연구 = A Study on the Vietnam Land Pricing System

국문 초록 (Abstract)

본 연구에서는 베트남의 산업화·현대화 시기 이후 2003년과 2013년의 토지법 개정을 통한 베트남의 경제발전을 이룩한 지가산정제도의 변화를 확인할 수 있었다. 그 주요내용으로는 첫째, 베트남은 중앙과 지방정부의 지가산정 조직의 체계화이며 둘째, 지가산정을 위해 토지법, 시행령 4개, 시행규칙 3개를 제정하여 시행하였으며 셋째, 지가산정을 위해 지가산정원칙의 작성, 기본지가의 작성, 지가기준표의 수립, 개별지가의 산정, 지가컨설팅 등 5개의 확고한 기본원칙이 있었음을 확인하였다. 특히 토지의 종류별·지역별 지가기준표는 기본지가에 대한 규정에 따라 11개(농업용 토지 5개, 비농업용 토지 6개)로 구분된 토지종류별로 적용하고 있었으며, 지가산정방법 및 적용원칙으로는 직접비교법, 잔여법, 수익법, 잉여법, 지가조정계수법 등 5가지 지가산정방법을 사용하는 등 자본주의 한국의 일반적인 지가산정방법과는 다른 점이 확인되었다. 베트남 사회주의체제에서 시장경제를 도입하고 이를 통해 각종 부동산 관련 세금징수를 단순한 방법에서 다양한 지가산정방법으로 변경한 것을 보면 경제발전에 많은 노력을 있었음을 확인할 수 있었다. 또한 본 연구를 통해 사회주의 국가의 고유한 지가산정제도의 변화를 확인함으로써 향후 통일을 대비하여 사회주의 북한지역에 적용 가능한 토지가격 산정제도에 대한 도움이 있을 것으로 예상되었다.

다국어 초록 (Multilingual Abstract)

This study confirmed the change of the land pricing system, made by the land law revision in 2003 and 2013, which had contributed the economic development of Vietnam after the period of industrialization and modernization in my research. The following is the main points of the change of it: First one is that the systematization of the organization for land pricing of the central and local government of Vietnam. Second, the government of Vietnam revised and implemented the land law, the related 4 enforcement ordinances, and the related 3 enforcement regulations. Third, I confirmed that there has been the 5 fundamental principles; making a land pricing principle; making a land price frame; establishment of a land price table; making an individual land price; a land price consulting. Especially I confirmed the difference between the land price system of Vietnam and South Korea. One is that the land price tables by a kind and a region have been applied to the 11 types of a land, such as the 5 types of an agricultural land and the 6 types of a nonagricultural land by the regulation of a land price frame. Another one is that the 5 types of a land price calculation method, such as a direct comparison method, a residual process, a rate of return, a residues method, and a land adjustment factor method, has been used for a land pricing calculation method and an application priciple. I also confirmed that there has been many efforts for the economic development through the facts that the government introduced the market economy system and changed the simple taxation system a land related to the various land price calculation methods by the market economy. In addition, this research will be helpful to anticipate a land price system of North Korea after the reunification of Korea by confirmation on the changes of the land pricing systems of the socialist state.
