유엔인권협약상 외국인의 이동의 자유 = 『시민적 및 정치적 권리에 관한 국제규약』 상의 권리 보장을 중심으로

국문 초록 (Abstract)

이동의 자유는 세계인권선언과 시민적 및 정치적 권리에 관한 국제규약을 비롯한 다수의 인권 문서에서 발견된다. 자유로운 삶의 일부로서 자유로운 이동은 기본적 인권으로 인식된다. 이 글은 특히 ICCPR 제12조를 중심으로 유엔인권협약상 외국인의 이동의 자유를 분석한다. 또한 이 글은 이동의 자유를 경제적 권리보다는 시민적 및 정치적 권리의 측면에서 살펴본다.
이동의 자유는 세계인권선언과 ICCPR 등의 인권협약에서 세 가지의 구체적 권리로 구현되고 있다. 첫 번째, 한 국가의 영역 내에서 자유롭게 이동할 권리와 거주지를 선택할 권리이다. 두 번째, 국경을 넘을 권리로서, 어떤 나라로부터도 출국할 권리가 포함된다. 세 번째, 자국에 돌아올 권리이다. 이 글은 3가지 권리를 상황의 흐름에 따라 입국할 권리, 한 국가 영역 내의 이동의 권리 및 거주지 선택의 권리, 출국할 권리의 순서로 검토한다.
이 글은 또한 유엔인권조약감시기구 중 유일하게 이동에 자유에 관해 상당히 구체적인 검토를 하고 있는 시민적?정치적 권리위원회(Human Rights Committee)의 견해를 살펴봄으로써 권리의 구체적 내용을 살펴본다.

Freedom of movement is recognised in a number of human rights instruments including the Universal Declaration of Human Rights and the International Covenant of Civil and Political Rights (‘ICCPR’). As a part of free life, free movement is recognised as a fundamental human right.
This article examines the right to freedom of movement of foreigners in the UN Human Rights Treaties with a special emphasis on the article 12 of the ICCPR. And This article’s analysis is restricted to freedom of movement as a civil and political right, rather than as an economic one.
Freedom of movement appears in three different rights in the UN human rights treaties: the right to move freely and to choose a place of residence within a State, the right to cross State frontiers expressed as the right to leave any country including one’s own and the right to return to one’s country. This three rights were explored in the following order in which they occur on the aliens’ position: the right to enter a country, the right to move freely and to choose a place of residence within a State, the right to leave a country.
This article examines how the Human Rights Committee, the only UN human rights treaty body that has explored the right to leave in significant detail, has interpreted this right in light of state practice.
